The police can do nothing at all!!It would be one persons word against another!!To make it an offence the police would have to take a breath test! Then who is to say you did not have the drink after you got out of the car!!My advice!!Watch out!! |

If you were driving at the time of the report the police would circulate your details and because of the report they would stop you and subject you to a breath test.If this was a report of you driving under the influence in the past there is nothing they can do really as the person reporting would not be qualified to give a legal opinion as to your condition. |

Nothing can be done. If someone reported another person for drunk driving and the police did not witness it than they can not do anything to that driver. It is sort of their word against the driver. The driver can always say that they did not drive while intoxicated. The police can keep the license plate number for future reference but that is about it. |

Just deny it, the burden of proof is on the accuser, if its your word against theirs the police will not persue it unless other witnessess can be found. |

Sadly the police cannot bring a charge, if you where drinking and driving perhaps they will have better luck next time and get you banned. |

I would say sue them for slander - if it was untrue and defamatory.
You can't just go around accusing people of things which are not true.
As they have told the police this - they will have the accused's name and details.
As they cannot verify that the statement was true, then all you need is a whitness to say you were not drink driving and you have a case against them. |

If the police do not see you driving or in your car (wih the keys) then nothing can happen to you. If it could anyone who was spiteful or had a vendetta could just make up stories to the police. The police need proof before they can act and the proof they require is an on the spot breathalyser or a blood test. |

i think the police or the person who reported you have to have proof of you driving otherwise its there word against yours. you really shouldnt be drink driving anyway so hell mend you if you do get done for it. |

For the police to arrest you, they need two sources of corroborating evidence.
Someone reporting you doesn't mean anything unless that comes with proof you were drunk. And even thats not enough without proof you drove your car (at least sat behind the steering wheel).
So, in answer to your question.

They will be asked to give a statement but if th police have not seen you then I think that not much can be done |

Well I really believe it varies from state to state, but if someone reports that they believe that you are driving under the influence of drugs or alcohol and the police find you and the witness testifies that you were behind the wheel of the vehicle, then the state can prosecute you for DUI |

What can they do? Er Nothing. If I phoned up and said you just robbed a bank whats gonna happen you go to prison for years for a robbery? There's no smoke without fire in this case Innocent till proven guilty you can't be guilty unless your on CCTV or police saw you. Just don't be a naughty boy next time and you wont have too worry. |
