my family goes to a bar every friday night and puts on karaoke for the bar. anyone is allowed in the bar if accompanied by a parent. my sister is 16 and she and the bartender have always gotten along and goofed off. the other night he wsas putting up some chairs behind my sister and he kept hitting her chair. she thought he was playing and aggravating her, so she pushed him in the back and turned back around. then the guy who is somewhere between the ages of 26-29 turned around and hit her in the back hard enough that the people at the whole table could hear it over the music. they called the security officer over, and he said that since they had been playing around earlier he couldnt do anything. my mom wnats to press charges, but the guy said he would counter-sue becuase my sister pushed him 1st. what do you think would happen. keep in mind my sister is 16 and he is between 26 and 29.

the place also has a bowling alley and arcade, so its not just a bar

He can't counter sue unless he has been sued. However, she shouldn't of touched him in the first place. She might be there with parents permission, but she is too young to be in that crowd. She should have said something first, then taken action by telling an adult, even if she thought it was a mistake. He has no right to hit someone that hard, but if he was hit first...he doesn't sound like the brightest light bulb. |

A Police report can be made. There is no suing involved. This is a battery situation, and can be resolved in court. |

First, you must separate suing from filing criminal charges. In this case, you are talking about charges. His striking of her would indeed be a battery. But her shove of him would also. It would come down to what the witnesses say and the court is probably not going to satisfy you with its outcome. |

First things first, call the police and file charges. He can't hit back unless he feels he is threatened, since she barely hit him and he hit her hard she can press charges. As far as suing, how much do you think you are going to get form a bartender? |
