What if you find a wallet, then return it, and then get a complaint of items missing and you never opened it?

my b.f. found a wallet at the oc fair and gave it to me then went to go get his drink. then a witness was pointing at me to another woman, who then came over to me demanding to look in my purse. Feeling intimidated i got up and went over to find my b.f to tell him what was going on and ask what the story was on this pouch. By now fair security was trailing me and i then gave it back to my b.f. and he gave it to the woman just to end this situation. It didnt end, she then claimed money was missing and the oc sheriffs made a report. we never opened the wallet up and no one witnessed us doing so. Yes, he found it on the ground, and told me to hold it, then after all the comotion we gave it to her not even knowing it was hers or not. never had time to open it or rifle thru it. This is a false claim, how can we get this dropped? its violation code 485pc. I received a letter in mail we have to go enter a plea on this complaint. how serious and what does this mean?

I'd go to court and plead not guilty and explain to the judge exactly what happened as you did here. As the police officer pointed out in an earlier response, unless she can produce witnesses that say they witnessed you or your boyfriend rifling through the wallet and removing things there's not much they can do. She will just have to cut her losses and be glad she got back what she did instead of nothing at all.

Also, File a counter-claim against her for lost wages if you have to take off work to show up for court.

i hate to tell you but i think you have fallen for the old dropped wallat scam. yes in my opinion you are in trouble.i,d get a lawyer fast. also have a background check run on this woman. it just may be the lever you need to pry your a** out of a serious jam. i,msorry to hear about this

next time when no one is looking kick the wallet to where no one will see you pick it up remove the goods and toss it above all never admit to any thing

Well I don't know anything about oc sheriffs, but I'm a cop in wisconsin and of course you guys look guilty, but if no one can actually say they saw you guys take the wallet from her, then we just chop it up to a loss. We ask if we can look thru your stuff and if you say no, then the answer is no and that's the end of that.
Obviously our laws are different from where you are.

Get an attorney and tell him your story. You're guilty of having the wallet in your possession and if no one saw it being opened then they can't prove a thing. The claimants could be lying about the missing money, or it could be really missing. Either way, get an attorney to go to court with you.

Ask the woman to prove she had the items in her purse to begin with.

They probably had this all set up. How could they have known who took it in the first place? It was like they were watching you the whole time or something. Sounds strange to me. Sorry I wouldnt know how to get this charge drop. Honesty is the best policy. Good Luck.

you enter a plea of not guilty, and you hire an attorney to talk to the DA, if there is no evidnce, they can not continue the case

One, go to court and let this fool prove you took it.
Two, tell the woman to give you back the wallet and you will replace the missing items - than fill it with dog turds.

It's a hearsay issue and it can't be proven. However, in your country they may work on the balance of probabilities, so I advise that you seek legal assistance.

you did not steel it, you only found it, so from the beginning you didn't do any mistake, so all what you have to say is the truth, you are not responsible for things that somebody just lost somewhere, so may be he lost the other things that he claims somewhere else!!!! just say the truth!!!

What's she claiming exactly? If the wallet was on the ground I don't see how they have any legal rights to stand on in this case.

Well i return it if i find it but i atach a note with this on it " Here is your missing object, if you think i stole somethin wick i didn't you are an #$##$@ so find someone else to tell your##$## Ok?!!!!
