What is the average sentace for man convicted of vehicular manslaughter in alabama blood alchol 2.4?

my brother had a car wreck he was driving drunk of that is not an issue. the people that he killed ( boy 16 and his grandfather) did run a stop sign. i need to get a handle on how much time he will get. he does have good lawyer

That's not an easy question to answer. The biggest factor is the judge - some are harsh and some are lenient in general. Some judges have particular "pet peeves" (like drinking and driving or pedophilia) and will "slam them hard". It also depends on how many D & D convictions he's had in the past. It is really a difficult thing to predict. If he retains an attorney from the local area, of THAT court that he will be going to, he can get a better prediction that say an "outsider" attorney (meaning a big city attorney that just just knows the urban courts if your brother is going to a rural community court). I know of the "average sentences" of a 50% suburb / 50% rural county about 50 miles outside of Atlanta and I would GUESS (no prior D & D conviction) to be something like - 15 years, serve the first 3 years in prison with the balance (12 years on probation) and a $1000-2000 fine. If he has had prior convictions then the prison portion would go up. However in Metro Atlanta - he might not even get ANY prison time - just probation and fine (because there are so many more different judges and more liberal judges). It is REALLY difficult to guess about a court/judge that you're not familiar with.

If he's white - 6 months probation.

If he's black - 12 years prison.

Good ol' Alabama.

By the way, I love how you point out the fact that he was drunk and then expect us to believe that his being drunk had nothing to do with accident.

I hope he rots in jail for a long, long time.

He will probably do three to seven years if convicted, maybe a little less for good behavior.

And there is no way his BAC was 2.4... He'd have been dead twice over. I think you mean 0.24, which is 3 times the legal limit, but not lethal.

Same thing happened to a friend of mine. He was sentenced to 15 years, but was his first criminal record of any kind. He served about 7 years and was released.

It also will very much depend on the victims family. My friend, everytime he would come up for parole, the victims family showed up and said he did not deserve to be let out yet, and they would not give him parole. Finally, after 7 years, the family told him they would not show up anymore, and that they thought he suffered enough, so he was released.

Also, it does not matter whos fault the accident was, bottom line, HE WAS DRUNK and people died. He is in some serious trouble

You must mean .24, 2.4 would certainly be death from alcohol poisoning.
