I just checked to see what my ex husband has been doing and I found that. I didn't know there were levels to a dui. I thought it was either you're drunk or you're not.

You didn't mention your state, but the levels probably determine the penalty.
The penalty may be increased by a very high alcohol content, refusing to submit to the test, or if you caused an accident and injured someone. Level 1 would be the worst, level 5 the least severe. |

In some states (like North Carolina), DUI's are called "Level 1" through "Level 5".
A Level 5 DUI is the lowest form of DUI. Level 1 is the worst DUI offense. |
