In the US, "how much" over the limit (assuming you are talking about DUI) makes no difference. The prosecution need only prove that you were impaired beyond your faculties. Though arguably such evidence may sway a jury in it's opinion, it really doesn't matter. You're either guilty of being impaired while driving or not. There are no "degrees" of DUI. What matters more is how many times you've been convicted of the same offense. You can go to jail. Likely you will pay a stiff fine and lose your license for a period of time if it's your first offense. |

In UK definitely lose your licence for at least a year, points and possible community service. They take it pretty seriously. |
