For example, say a group of officers are pursuing a young man running away on foot after robbing a store. The officers lose track of him, but a few blocks later they come upon a man who looks similar and they order the guy to stop. The man doesn't stop and the police shoot and kill this person. What kind of punishment would they face?

Typically, they don't face any punishment at all.
In fact, they may even receive a medal for their "bravery".
That is exactly what happened in a recent case in Minnesota, where cops raided the wrong address and shot up an innocent family. Unfortunately for the family (who thought the police were criminal intruders, because they did not identify themselves), they shot back in self defense, and were arrested as a result.
I guess if the cops want to kill us, we are expected to just let them. |

Third Degree Murder for unlawful use of deadly force. You can't shoot someone unless you feel that your life or the life of another is in immediate danger. It has nothing to do with shooting the wrong person, its the fact that the officer is using deadly force without proper grounds. It wouldn't matter even if he shot the "right" one.
P.S. I know that legally you can shoot a fleeing felon, but there are very tight restrictions on that such as you have to prove that someone is in danger of being killed if you fail to use deadly force. This use of force is so questionable that 99.9% of police officers don't even consider this an option. |
