My daughter (15) has recently been given a phone from her dad. They are reconciled after 13 years and he lives abroad so the phone has alot of sentimental value. One of my daughter's 'friends', 18 (whom I've warned my daughter about cos her whole family is bad) asked to lend the phone on 9 March. As soon as my daughter told me this I said 'You won't get it back now' and I told her she should not let ppl overwhelm her (which she has a tendency to do.) and she said 'Oh, I'll get it back, she's not that bad'. Anyway, the next week, my daughter asked for the phone back and this girl said she'd given it to my youngest daughter who's 12 so I rang my youngest and she said she's never even bumped into this girl. I went and spoke to her mother who also said 'oh, she's given it to your youngest' I assured her that the phone had not been given to my youngest, who by this time was getting visibly upset at being blamed. The mother said she would send her daughter round to my house. I thought, 'Good, there's no way she could deny it if all parties are there'. 10 minutes later she knocks on my door saying to my youngest 'I gave the phone to you' and continued to deny she has the phone for 5 minutes. I ended the conversation by telling her to expect the police at her door. The police arrived a few days later saying they would go round to see her and ring me the next day with an update. 4 days went by and I rang them and the operator said the officer had put on a report that no crime had been commited!! I don't know what to do. What should the police be doing about this? I want that phone back and don't see why she should get away with keeping it or selling it or whatever she's done with it. Advice please and no need for saying how silly my eldest was for lending the phone in the 1st place, we already know that. Thanks very much for your time.

I'm in the UK.
The phone was a pay as you go phone and she took her sim card out of it before giving it to this girl so no point ringing it.

Well, I would contact the phone's network provider and cancel the phone immediately for the reason that it has been effectively stolened. Your 15 year old should pay for all fees resulting from this mess. It will teach several lessons:
1. TRUST NO ONE
2. Never Lend anyone anything
3 Never co-sign anything.
4. A child should always listen to her mother.
Again call your phone service and cancel that phone --- stop the bleeding of money NOW |

The police will not do anything because your daughter loaned her the phone, it was not stolen. You could take it to small claims court (i am in Australia, not sure what it is called over in US but there is only a small fee to be paid and no lawyers) it may not get you the phone back but you may be compensated to get a new one, but there is of course the chance that the judge will do nothing. If you did your daughter may have some trouble socially, especially if this girl who has her phone is a bit of a delinquent. It may also be important teaching this girl a lesson and maybe showing your daughter to not be walked over and find some valuable trustworthy friends. Good luck. |

Unfortunately the police are right. They can only go by the law, and the law says that something is only stolen if it is taken without the consent of the owner. This was taken with the consent of the owner and it is not the job of the police to get it back. You could see a solicitor (in the UK, most solicitors will give a 30-minute appointment free). If you have to pay them for follow-up action, it could work out cheaper to get a new phone, but you can get an estimate in your first appointment. |

I agree with Karen. Call the cell phone company and report it stolen. Get any unused minutes transferred to another phone. Get any details on phone calls made on that phone after the phone was lent. The people who were called could verify who called them.
Have you tried calling that phone from another line to see if it rings, which it should if it is not turned off.?
Your daughter has learned a lesson from this. Don't buy her a new phone. Get her to pay for the replacement phone if she wants one. She took a risk against your advice and lost.
The police is not going to get involved in figuring out who is lying. |
