i went to safeway earlier today to buy some grocery's,the store didn't have the bread i usually buy so i put an item back and left without buying anything,i walked out and was bending over to unlock my bike when someone started chocking me from behind while another guy grabbed my arms and started to pull me to the floor,they kicked my legs underneath me to knock me to the floor and began to handcuff me while sitting on my back,I had no idea what was going on and assumed they were cops,turns out they were security guards working for safeway(3 men in late twenties in street clothes) they searched my stuff and after finding out i hadn't stole anything tried to just walk away,i was upset and told them to call the police so that i can file a complaint,the police told me they cannot arrest them because its a civil matter but that i should call the corporate office to complain or even get a lawyer to help,i have never stolen anything in my life or assaulted before.these guys never even tried asking me if i stole something or asked if they can check to see my stuff they just jumped me,i wasn't even running i was walking with my back turned when they attacked,they told the police they thought i had took some lunch meat,the cops said they shouldn't have reacted this way over something like this,i am still pretty upset and not sure who i should complain to about this,i did get there names and supervisors name.

Get a lawyer. Speak to the cops again and try to file assault charges against those guys. This story seems pretty unusual since asset protection staff are carefully trained not to physically stop a person unless they're 100% sure they're walking out with a stolen item, and I doubt a pharmacy would hire that many guards, but this kind of thing has happened before. Some businesses (such as Wal-Mart) have been known for having over-aggressive security guards, and they've had the crap sued out of them for this sort of behavior. |

I would report it to the store manager as well as the district manager, and especially the corporate office. When you do, demand a face to face apology from the "security" personnel that jumped you, and also ask what else they can do to rectify the situation for you. At the very least, you should be able to get a nice gift card for the store out of it (at the very least $100 since you were assaulted)
If you want to, you SHOULD be able to go to the police and press charges of assault and battery given that you were assaulted and physically restrained. At the very least you will then have a police report available. Make sure to have photos taken of any injuries you sustained, bruising, etc. |

If your facts are accurate, you have witnesses and you are telling the WHOLE story, call an attorney, your case is in his/her win column. If not call an agent, great story! |

Store security do not have the right to assault anyone. This would be a cause for a lawsuit BUT...
You might be out of luck if you don't have any witnesses to testify on your behalf, or the incident was not caught on tape. They'll more than likely make up some story about how they confronted you and you became violent and blah blah blah.

Generally, property owners have the right to detain and search people on their property who they reasonably suspect are trying to steal from them. These people might have over reacted.
Your only recourse would be to sue them in civil court to recover damages. |

What to do? You already talked to the cops. The guards gave you good advice on making a complaint. Follow that advice. |

You have been assaulted...get a lawyer and go back to the police station and file a complaint of assault and battery. Make sure the cops take pictures of your bruising and get your lawyer to do so too. Then get the lawyer to write a nasty letter to Safeway letting them know what their security thugs did. By the way, don't sign anything from Safeway unless your lawyer tells you to...they may try to trick you into making a settlement for far less than you can get through court!
