What will happen to him?

this bloke hit me so i pressed charges on him and he has to pay me 100pound compensation and 12 months community service. he was one of my friends boyfriend, i have just found out that they have split up and she hasnt seen him for a month. if he dosn't pay up or go to community service what will happen to him?

UK answer - if someone misses their community service (now known as Unpaid Work) on two occasions without providing an acceptable reason (such as a medical certificate) they will be taken back to court. In the first instance they will normally be given more hours to complete. If it happens again they might get a curfew. Ultimately that person might be resentenced, possibly to custody. If he does have to go back to court he will be sent a summons. If he doesn't attend court, the court will issue an arrest warrant for him.

With regard to the compensation, the court will have made an order for him to pay. If he dosn't pay up they can attach this to his benefits or earnings, so it is deducted from his money directly.

If you are worried about being re-victimised by this person talk to your local victim support service, who will probably be listed in the phone book. If they are not, contact the court or police station and they will give you the number.

Hi all, im from England but not much longer. Plan on moving to Australia. The law here says one thing and does another, he will more than likely get off with it. They will properly arrest him again, add another fine to the one he has already got and allow him to pay £1 a week or something stupid like that. The government here are in the news for how they treat people who break the law because they have let immigrants walk free from terrorist acts and let prisoners free from life sentences within 5 years. Hope this helps. I would appreciate e-mails from people in Australia with any info on the country, especially schools and university and the health care system. I am a nurse from the UK looking for the ideal place to settle in OZ. Thanx to all. XXX

I think, but I'm not sure, that he could go to jail. Do they have a different name for it in Britain?

If he doesn't pay you what he was court ordered to pay you for assaulting you and doesn't complete his community service either, then a warrant will be issued out for his arrest ...... even if he dissappears for a little while or some time .....he will eventually get picked up somewhere down the line. It only takes one time for him to get pulled over, or anything to where the police are involved for them to see the warrant issued under his name and he will automatically go to jail and face the charges and fines he would owe you. If he doesn't show up for community service or pay you ...then first I think they would go to his address that they ave on file for him, but even that doesn't mean they'll get him. He might have even moved or anything......you never know, just stay on top of it !!!

A warrant will be put out for his arrest and if he is found/caught/turns himself in he will most likely recieve more fines and possibly jail time. Now, this is based off of US judicial system and experience I have had from some friends I have that aren't very intelligent, lol. I am not sure exactly if it would be the same in England. I am sure though, if you called your local law enforcement and posed the question they would be more than happy to answer any questions you may have.

well that depends on the law over there. In australia if he aint showing up for community service or even to court then he will either have to pay more and do more community service or jail time depends... Also if he has only a first offence charge or if he has been charged b4, this plays a part in our light or stricked they are

Unfortunately, absolutely nothing will happen to him at all. He will not be punished for not paying the fine, and he will not be punished for being a no-show on the community service.

The judges are too soft on criminals like this.

You could speak with the Citizens Advice Bureau, who wil be able to give you more formal advice. They are understaffed, and public demand for their help is huge, so be prepared to hang on the phone or wait at their offices for quite a while.

I'm really sorry that you were hurt by this coward.

Is is a bad situation. Do what you can with the support of the authorities, but try not to let this get you down when nothing happens.

Prepare yourself for disappointment and try to forget about him and move on. If he troubles him again, then it would be good if you have a couple of big male friends that could have a quiet word with him (no direct physical abuse, just words).

Jail, because failing to obey the court is a contempt of court which they will view as a serious matter. Im not sure on the sentence though, I think a contempt of court is actually an indictable offense (Only triable in Crown Court, the serious offenses, Ie Murder is indictable) I could be wrong it may be a hybrid offense. Thats what teh sentence will depend on, because the magistrates court maximum sentencing powers is 1 year and/or £1000. Whereas a crown court can pass what ever they feel necesary (which probably wouldnt be too much more at the maximum)
