What would happen if I did not let a cop search my car?

You are well within your rights to say no, and they can not hold that against you. Chances are, they would just let you go.

If you say no, legally, they cant search your car without a warrant. if they do, you can sue.

Nope say no, unless they have probable cause or a warrant they can't search your car. I mean if they walked up and you opened the window and you were smoking up in your car they could search it but I don't see any reason in your situation. I've said no before even when I didn't have anything illegal on me, but it is your right.

The biggest thing if you have nothing to hide let them search.
If you had said no then you would have been sitting there longer because they would of ended up doing it any ways and write that it was under suspicion.
so if you don't have anything to hide let them do there job.
If you refuse the search of your selfs could of leaded to them saying you became aggressive or anything non cooperative,and you could of been sitting there even longer and in the back seat of the cop car

You could deny the police the request to search the car. If the officer felt he had probable cause, he could search the interior of the car without your approval. He'd could get a bench search warrant to search your trunk.

As a lay person I would say:

If you had said no it would have increased your wait time.

You would have had to wait while they got a warrant to search it. Of course, they would have had to state the probable cause to the judge they had for wanting to search it and their suspicion would have had to be on the warrant and if they found nothing or if they arrested you on false cause you would have cause to sue for being detained illegally.

But that's just speculation of a lay person not an attorney.

That is the catch-22 in search and seizure that cops exploit all the time...If they have probable cause they can search you and the car...If they don't and you refuse they consider you saying no gives them probable cause...and if they find something you can't claim illegal search and seizure cause they can say anything that gives them probable cause i.e. they can say they smelt weed or you looking high and there is no way to prove otherwise... the smart thing is what you did just lucky nothing was in the car...

Decline the search politely. Ask if you are being detained for any reason. Then ask if you are free to go.

If the officer says "if you have nothing to hide you will let me search your car" you simply respond with "I value my privacy and decline a search"

If you are asked to get out of your vehicle, roll up all windows and lock your car door IMMEDIATELY after you get out. They may try to say they will call in a drug dog, but if you really have nothing in your car don't sweat it.

well the could do alot of different things
they could get a drug dog to sniff around your car to see if it hits on it if not they may let you go
they could tell you that they are going to take the driver to jail cause speeding is a crime and they dont have to write a ticket but they can arrest you then they will tell you that they have to impound the car and do a search on it for impound reasons (true story)
or they may just let you go on your way

You cant stop him once you tell him he can. yes you can say no if he wants to though he can call a k-9 and the k-9 can sniff through your car. the officers cant move anything or actually search them self's but if the dog indicates it smells something in a particular spot the cops can then search that place. if something is found it is now lawful for them to search your entire car. street cops dont get warrents for cars!!! if you say no they are going to assume its for a reason. all they can do from there is bring the k-9. if that k-9 finds something you whole car can and will be searched.

they would call the drug dog and have it sniff the car,make you take a field sobriety test.just generally harass you,detain you longer while they get a warrant

They would get more suspicious and probably try to find of ways to get you in trouble. They can also call in more cops for backup if you don't want them to search. It happens..

I don't know exactly what the law is in your state but in my state you can't not let him search your car. If he stops you he has a reason to search which means he will. The only thing in your car that he can't search is something that is locked. Then he would have to have a warrant. But as far as the vehicle goes he can search anything unless it is locked no matter what you say. Most of the time they only ask because if you say no most of the time you have something to hide.

if you refuse to let them search thats reason to arrest you but they cant hold you for too long ..but really they only ask if they suspect something may be in their so no matter what once they suspect that their going to look so dont drive around with anything illegal... and i think in some places they have to use the dog first and if the dog signals at something then they have the right but if it doesnt then they cant or something like that not 100% sure in that case

they would probably arrest you because if you have nothing to hide why would you not let them.
