I was pulled over for speeding. I was slowing down from a 55 to a 40, I gess I did not slow down fast enuff.I did have a few to drink ,I was not drunk only very little beer buzz.I thought I was going down town to be booked.He asked to search the car for open intoxices.I knew there was nothing in the car, so I said OK, and I thought I was being arested and they would search car anyway. Well they found a little pot on both people in the car.They got taken to jail and I got to walk away with a speeding tickit. I gess they got something better and didn't care about me drinking and driveing.This seems wrong I was the one that could of hurt somone Not my friends. Should of stayed home.
I FEEL VERY BAD that my fiends are in troble.

yep... it's for his/ her safety, to check, and make sure you have no weapons, and also, if he feels his/ her safety is at risk, may put that person in handcuffs, while he searches the vehicle... also, to make sure no drug paraphanelia is on that person... |

You gave them consent to search the car. The Officer may pat down people in the vehicle for his/her safety. They may also ask the individuals if they can search them further. If the individuals consent then the Officers may search further. Also, if the Officers can smell marijuana then they have probable cause to search and don't really need consent to search. I was not there so it is hard to tell what he Officer saw or observed or did. It will be up to a judge to determine if the search was valid and if the charges stand. There is no way for someone that was not there and/or has more information then you provided can make more then a guess if the search was valid. |

They can pretty much make up any excuse they want to search you, unless it is really outrageous or uncalled for it will hold up in court. Dont carry anything on you or hide it *VERY* well (engine compartment is a good place, double wrapped to defeat dogs) never agree to any searches so if they do search you illegally it wont hold up in court. If you refuse a car search most likely they will hold you for a K9 unit to smell around the outside of your car |
