Our prosecutor's office responds to certain crimes when they occur--homicides, major crimes, some domestic violence cases, child abuse cases.
Others we don't see until a complaint has been filed and we screen it for the first court proceeding. We read the reports, decide preliminarily what we intend to do with the case (downgrade to municipal court, dismiss, refer for further investigation and possible indictment).
For serious crimes (homicides, DVs, child abuse) it is important to be involved at the earliest moment to provide assistance and guidance to the local police departments. |

The prosecutor's office should become involved after reviewing the police report and determining whether or not to pursue the charges the officer chose to press. A lot of times the cop issues a ticket with the wrong statute cited, they just aren't trained enough in the law they are out there to enforce. |
