When is a police officer allowed to enter your home without your permission and arrest you?

There are more than one instance in which this would be permissible. The first would be what is called "fresh pursuit." In other words I saw you commit a felony and you ran in the house. I ran in the house right behind you or broke the door down immediately to continue the pursuit./

Second would be if you are a parolee. As a parolee you have no rights to refuse a search of your house, your person or your vehicle. That is why Parole Officers are very nice to have around. Especially for repeat offenders. It saves time obtaining probable cause and such to obtain a search warrant.

Third would be a term known as "plain view doctrine." In other words I directly observe you committing a felony or a felony in progress if you will. I may enter immediately to prevent the completion of the felony or destruction of evidence pertaining to that felony.

Fourth would be the issuance of a lawful warrant by the court. This warrant will be signed by the judge issuing the warrant and must describe the precise location(s) to be searched and what is to be searched for. Anything found outside of the guidelines specified in the warrant would generally be considered inadmissible in court.

There may be others, but this is the best I can do off the top of my head.

When they hear gunshot(s) from inside, screaming....neighbor's tell them there was a fight outside and they went inside to continue it.
You know, that's about all I can think of...some officer I'd make! Hmmmmph!!!

1. If the police knock and ask to enter your home, you don't have to admit them unless they have a warrant signed by a judge.

2. However, in some emergency situations (like when a person is screaming for help inside, or when the police are chasing someone) officers are allowed to enter and search your home without a warrant.

3. If you are arrested, the police can search you and the area close by. If you are in a building, "close by" usually means just the room you are in.

When they have a warrant for your arrest and you don't open the door. Don't you watch "Law and Order?" Is that when you cursed at the police officer?

Sophiesmom
They dont need a warrant if they have probable cause...If your killing someone at the moment they dont need permission to come in...

if they have a search or arrest warrant, or if they can see something in plain sight just by peeking in.
you should never invite them in, always go outside to talk to them.

Welcome to Colorful Colorado
Before there was the Patriot Act; they needed an arrest warrant from the judge. Now if you are a suspected terrorist (defined in the Patriot Act) they can come right on in! Thanks Bush!

Police aren't allowed to come in your home and search you unless they have a warrant or probable cause. amendment 4 of the constitution.
