Once you are pulled over, if the officer believes you are under the influence, he will begin to ask you a series of questions. Depending on your answers, he may give you a battery of field sobrieity tests. If the officer believes you have failed these tests he may give you a field breath test. If he feels you are under the influence then he will handcuff you and then take you to jail.

First, field sobriety tests will be given. If the officer believes you to be impaired, he will handcuff you and place you under arrest. You will be taken for a chemical test, either at a hospital or jail, then booked in. This procedure may not be the same as practiced by all agencies, only what we do at mine.

No. After taking field sobriety tests, and it is determined that you are under the influence, you are placed under arrest. At this point, you are read your Miranda Warnings, and the Implied Consent warning. You are then transported to the station where you will take a breathalyzer if you agreed. After finalization of the paperwork, you will then be incarcerated.

no...first you get a field sobriety test and if you fail it, off you go to the pokey.

Assuming you failed the DUI tests, then yep, you are 'cuffed, and hauled off. In Wyoming, you will spend the next 24 hours in jail before even bail is posted for your release.

I don't think they need the handcuffs if you co-operate.
You'll have to ask Paris Hilton if she got the pink ASP handcuffs!

Same answer as some of the above, just different order.

You get pulled over
You get to take Field Sobriety Tests
You go to the jail where you take the intoxylizer breath test

If you fail the breath test we would usually cite and release. Our jail was always full and if you could get a friend to come sign for your butt then off you go. Even our impound lot was full so we would turn your keys over to your friend and tell him to go pick it up. Only if it was a felony DUI would you stay in jail. Yes, we did pull the same person over more than once in the same night.

In our State, which is Texas, when they stop someone who is DUI, they are arrested and taken to Jail, I do not know if they are Handcuffed, but my guess is Yes.

Yes. The other option would be letting you get back in the car and drive away.
