depends upon the state. some states such as Florida have a Castle Law, where your have the right and obligation to protect your castle. Some states side with the criminal.

If you must shoot, shoot to kill! you only want one story told - yours.

Geoff
Where do you live? There is no Burglary Committee making the laws for evey nation.

In Britain, you cannot kill someone for burgling your house. You CAN kill someone for attempting to kill you.

HOWEVER: Britain, being a nation more than ninety seconds old, has some glorious oddities in its rulebooks that date back to the time Christ was being crucified by dinosaurs. One of these is that, if you hit a burglar with whatever the first thing to hand is, that's fine. It doesn't matter whether you clock him with a damp squid or a hundredweight of TNT, provided it's a simple reflex action, you walk.

As far as Fl is concerned, you can use deadly force.

Curtis
You can shoot to kill but make sure the body stays in the house, and also put a screwdriver in the burglars hand, to act like he had a weapon.
Breaking and entering in my house is a death sentence.

Depends on your state. If you are in Georgia, and you feel your life is threatened, you can kill them.

It depends on the state and local laws where you live.

It would depend on the state you are in and the particulars of the situation. In Florida, you would have the right to use deadly force on someone who broke into your house. If you used deadly force in the state of Washington you might have a problem if all they did was break into your house...

It depends. If you are at home at the time, you are allowed to use reasonable force to protect your home and family. HOWEVER, on occasion property owners have gotten into trouble for going to far: setting deadly traps (really!), chasing a guy OUTSIDE and attacking in, etc.

tom_p1980
Nothing, you and your family have no rights what so ever. You want to hope that the burglar doesn't injure himself as you may be liable. And yes I am being serious. The law protects the criminal not the victim.

You can use non-deadly force to protect your property. You can use deadly force in response to a reasonable perception of imminent bodily harm. If a drunk comes in and falls asleep on your couch and you kill him, it will be murder. If a burglar comes in, at night, at is armed in some way, or in some way manifests a threat, then use of deadly force will be justified.

You are allowed to use reasonable force, but unfortunately this has not been properly defined, so you could end up being accused of assault.

U k take them out to lunch and try and understand them U S Texas They well find your rib cage in a canal....we sure is backward people

Well, I think you just have to do what's necessary. There's no reason to harm them on purpose if there's no threat to you, only your property. If you can just scare them off - then that's the best option surely. Then call the police. They're the law and it's up to them to enforce it - not you.

"Reasonable force" in other words not a damn thing !! But the police told me if they are coming towards you and you feel in danger you can do what you need to to defend yourself... So as long and you do it to the front of them and not the back anything you like :)

I'm with you. The law should be that if someone enters your house without due authority or permission, then any consequences to that act are of their own doing.

You have to make sure they don't injure themselves as you have a duty of care to even trespassers so make sure you don't have any loose rugs etc.

As a woman who's 5.2" I find it funny that I'm expected to have a plan of action and think about if how I'm fighting back is reasonable when an attacker wouldn't care what's reasonable. If somebody was trying to attack me I would grab the biggest knife and there's no way they would have chance to do anything to me.

JTtheLAR
Kill them, but if you only wound them they are permitted to sue. Yep

chattterus
You may defend yourself as long as you are in danger from that person. If you knock him/her out or the burglar runs away, you are to stop immediately from anything that could harm him. If you kill a person after knocking them out you are guilty of manslaughter.

T.J.
If they are in you home you are permitted to kill them. A bugler standing in your home is considered to be a threat to your life. You have the right to kill someone who is posing an emanate threat to you life. If they are standing out side your home the law is not quite so clear and it would depend on the exact situation.

It depends on what state you live in. I read someplace that in Texas (I think it's Texas), if they have one foot on your porch and you shoot them, that's considered self-defense.

Look out, Jehovahs Witnesses.

you should check your own state laws.

In Texas a guy came outside and killed 2 guys with a shotgun that were robbing his neighbors house. No threat to him. He got away scott free. (he was white they were dark colored illegal immigrants)

In New York city, A black guy came outside his house to confront NEO-NAZIS who were threatening his family and saying they were going to rape his wife and daughter and kill them all. The gun accidentaly discharged killing an 18 yr old WHITE neo-nazi. That black guy is now in jail for murder.

So check the laws in your state and make sure you are a White person. If you are not, I would suggest non deadly force. So the super corrupt police dont put you in jail....Super corrupt.
