So, which do you think was better? I have an opinion, but I wanna make sure I'm leading in the right direction. and if you would be so kind to give me some reasons why.

It depends on what your views on crime and punishment are.
As a Police officer, it severly ties your hand in regards to dealing with youth. There are young offenders we deal with on a regular basis (weekly or more) that are constantly released. YCJA limits the crimes that YOs can be held in Police custody. Do you know how often I hear "hurry up and call my parent so I can go home".
Yes, children make mistakes. They are not as developed mentally and deserve a break or two. There needs to be fail safes in the system to catch these children. Formal cautions and restorative justice are appropriate.
But there are YOs that are being arrested for the same offences repeatedly (break and enters, thefts, assault, mischief, threats, etc) and are being released on conditions. I know of youths that have over 100 breaches of these conditions without spending a night in jail. When court time comes, they work a plea bargain and 100 becomes 5. Guess what they are sentenced to, Probation.
While the YOA wasn't ideal either, my opinion is that the YCJA is moving in the wrong direction.
There has to be some way to deal with repeat offenders. The repeats know exactly what they are doing and what they can get away with. They also know to have as much fun as they can until they turn 18, because there are little consequence.
No locking them up is not a great idea, but neither is teaching them there is no consequence to their actions.
FYI- one of the little ***** who demanded I call his mother so he can go home was just involved in a home invasion where the elderly occupant was home at the time. He laughed about the situation. I am pretty sure she will never get over it. |

Personally I don't. I know there are good cops and bad cops out there, but the bad cops have really made the rest of them look bad as far as I am concerned.
