Who has the right-of-way at this intersection to get onto 44 eastbound?

The people turning left from the southbound lane of Berry road are turning left on a green light (no arrow).
The people turning right from the northbound lane of Berry road are in a special right-turn only lane that has a Yield sign.
According to Missouri statutes, anyone turning left must yield to oncoming traffic. Also, anyone with a yield sign must yield.

But somebody has to yield and somebody has to go!
So who has the right-of-way?

The person turning left has already cleared the main highway and established his lane by the time he approaches the yield sign.
Because he has already completed the left turn, that portion of the law would not apply. The statute covers this in paragraph 3, where is specifies "approaching from the opposite direction". By the time you get to the sign, you are both going in the same direction.
The person with the "Yield" sign must wait until it is clear. That is covered under paragraph 4, where it states they may designate any intersection as a stop or yield. |
