hello good people
my girlfriend been hit by another woman the other woman start it first and my girlfriend said the other woman hit her in the face hard as can be and now my gf has to go to court this is her very first offence has anyone got suggestions remeber the other woman start it first

no my gf was only talking this guy and the other woman was jelous i dont know if there was witenesses around as im in australia my gf has a lawyer i keep telling her that you will get a fine or not even that as you did not started the fight

Regardless of who started it, without witnesses there is always a case for assault from both parties.

Police have to remain impartial without eyewitness accounts

Chances are that the case will be dismissed due to lack of evidence

Unless there are eye witnesses, in which case there shouldnt be a problem if your girlfriend is genuinely inocent and only acted in self defence.

she should be OK, as there was no witnesses,her word against the other girl, if your unsure contact a lawyer, first 30 minutes are free, hope that helps, good luck, don't have any contact with the other party,it could be twisted,all the best hope it works out.

It would be difficult to give a fully accurate answer with the limited information you have provided. However, if your girlfriend retaliated in self defence, then i doubt she will get a penalty at all. You must however be sure that it was actually self defence as there's a very thin line between self defence and assault.

Generally speaking, self defence is either ONE strike in response to being struck or a preemptive strike, (a punch etc before the other person hits you) if you GENUINELY fear for your safety from an IMMINENT attack.

If the other woman threw the first blow, your girlfriend has the right to retaliate in self defence, as long as she used reasonable force.

Ok, did your girlfriend entice this women to behave that way? If she did, it could be a different story.

If your girlfriend was merely defending herself then she may claim she acted in 'self-defence'. If your girlfriend crossed the line i.e she got the better of the woman and continued to hit back even when the woman no longer posed a threat then her claim of 'sel-defence' is flawed. In this case she would be equally as guilty of assault as the other woman, regardless of who started it first.

Whatever is in the report , the judge will hear the complaint and will be given a sentence of whatever they decide.

If your girl has any personal injury , she may have a better chance of collecting punitive damages from her injuries also.

unfortunately the law is an a*se. It takes two to fight if she retaliated, she may find herself in trouble as well. All depends if the other girl has previous, and if your gf has a record.
