Who is responsible for this damage due to a fire truck?

Burn Ban Lifted
Effective immediately, March 27, 2009, County Judge ..... has lifted the burn ban for all of .....County until further notice. Anyone doing a controlled burn should monitor the local weather and watch for a Red Flag Warning indicated that weather conditions will promote fires that are difficult to control. To check the Red Flag Warning status, go to http://fire.boi.noaa.gov/. As a precaution, keep a supply of water ready and available and notify the local fire authority of your controlled burn.

It is quite possible that although you were not under a burn ban, a red flag warning was in effect (I'm in Texas also and they have been frequent lately). During a red flag warning it is not wise to burn due to the increased danger of the fire spreading. If that was the case, you are at fault due to burning in dangerous conditions (high wind).

The fire got out of control because you were careless. Even though it was not intentional, you are expected to keep your fire under control at all times.

The fire department, on the other hand, responded as a result of your actions. A fire can double in size in one minute, so every second counts. Their actions were reasonable.

You are responsible.

I would not think you are responsible, you didn't do it.

As for the fire dept., I don't think they can be held responsible. They were doing their job trying to put out the fire and these things happen. There is really not much that can be done. It's unfortunate, but clearly it's not your fault.

He is another pretender answering questions with guesses claiming he's a cop, yet he's asked his own questions about cop related issues in other groups. REmember, many of the "cops" here are faking it and this guy is one of the worst.

You are responsible they will say you should have been more careful. You may even get a bill from the fire department.

when you burn something yo uhave to watch the weather and be very careful as well as it is your resposibility to keep it contained and you called the fd so it is your resposiblity to take care of all damages that were done...because they were coming to you because you called them and had a fire out of control and they came to do there job and thats what they were doing. sorry but you need to take care of the repairs.

Since you were the one burning brush, it is your responsibility to make sure it remains under control. The fire department responded appropriately due to your inability to fulfill that responsibility.

They are not responsible for the damage. They did not act negligently or inappropriately to cause it. Unfortunately for you, you are most likely going to be held responsible for it.

Just so you know, if any damage was done to the fire truck, any of their equipment, or any injuries to a firefighter had occurred, you could have been held responsible for that as well. Be thankful it's only a field and not someone's life.
