Whould this be considered theft?

My ex roommate owes me money. She had ample oppurtunity to repay me before I moved 5 hours away. Now she seems to be avoiding me, and avoiding paying me back. I've been tol dof it os over 20 dollars I would need proof. What would consitute as proof?

To claify, she did not borrow money from me. We enrolled in a class, and the fees were paid on her credit card. I paid her cash for my half. Because I moved suddenlt I dropped the class, and was partially refunded. This money went back onto her credit card. She never gave me the money that I was riembursed on her card. She now plans on moving to Ireland, and is being pesky with not giving me this money.

No it's not "theft." You gave/loaned her the money. She didn't take it without your approval.

Proof would be a written receipt.

no, but if you had a receipt it could be considered fraud, if no payment
has ever been made...well, maybe petty theft, yes.

Sorry but it is not theft. You'll need to file in small claims to get your money back.

Theft is taking something without the owner's knowledge or through deception. Because you cannot prove she didn't intend to return the money you cannot prove theft. I know you feel that she took without intention to repay, and that her actions make it appear that way now, but unless you have someone ready to swear that is the case you have no proof of theft.

I'm sure police would not consider this theft,but you can settle this in small claims court. Let this be a lesson to you never borrow money or get a written receipt. Never spend money you don't have!

Every time Someone owes m money over 20 bucks, I get them to write a statement... Last time i didn't I'm out 3K from some douchebag who "bought" a truck from me...

So the possibility of you getting your money is Nil...

it's not considered "theft". But it can be considered an unpaid debt and settled in small claims court.
