Why are cops so retarded? Car Accident?

Lets start out explaining, My wife was in an accident. She was waiting at a green light to turn left. When the light turned yellow there was a guy about 100 yards away that looked like he was slowing down so she went. Apartently that guy gunned it and hit her back end of her car, launching him into the traffic light poll and totaling his car, maybe even hers. Three witnesses pulled over to the sceene and all 3 reported that the light was red when the accident had happened. My wife reported that the last time she looked the light was yellow. The guy reported that the light was green (OBVIOUSLY). Judging by these comments which side would you support. I am assuming that it was his fault correct. Well the police officer said that there was no fault and that the insurance companys can figure it out. (BS) Well, our insurance is demending that there is a person to be at fault, what can I do?

She was already in the intersection to turn left. You know how you wait at the light it turns yellow and one car gets to turn left (That was her). That kind of situation.

try to see if there are any cameras near by or if the city has any traffic cams in that area and ask for video...but on the retarded cops subject....yeah there are alot of dumb ones i got searched inside a resteraunt one cop asked to search my car under suspicion of weed i let him he searched my friends car with out permission or a warrant...he had mine...not hers...they let us go...if not...i would of made them the laughing stock of the area

Why would you call the cops retarded? They are not judges. It isn't their place to sort out guilt or innocence right there at the scene. They make a report of the facts at hand. They report the witness statements. They report the statements of those involved. And they report their own observations. It is not the police officer's place to decide who is telling the truth and who is lying. If it makes it to court, that's for the judge to decide. If it doesn't get that far, the insurance companies settle it. If you're not happy with your insurance company, drop them or sue them. But to call the cop retarded is un-called for, and indicates more about your intelligence than the cop's.

the other guy had the right of way. So it's really your wife's fault. Turning traffic has to yield to oncoming traffic.. If no tickets were issued to the other driver for running a red light there's not a lot you can do.

Let the insurance companies sort it out. That is what you pay premiums for. It is very likely that this particular case will end up a no-fault situation because it has too many conflicting reports. There is no clear fault in this case as both your wife anbd the other driver were apparently in an intersection after the light had turned to red.

You have stated what the officer said on scene, but you did not say what the accident report stated. Most states (mine included) REQUIRE the police to complete a report if the accident is serious enough to warrant it, which this one surely falls into that category. It is your, or your insurance company's, responsibility to obtain a copy of that report. Most police officers (myself included) are reluctant to say at the scene who is "at fault". That information will be in the report after I have completed my investigation of the accident.

I put the phrase "at fault" in parenthesis because some states (mine included) are not "at fault" states; that is to say that the police do not determine who is at fault per se, but rather determines the "primary contributing unit", which is pretty much the same thing. The insurance companies will decide who is "at fault" and therefore who pays for the damages. This is a civil action. The accident report merely reflects the investigating officer's opinion of what happened based on physical evidence and witness statements, as well as the statements of the drivers themselves. Each is weighed on it's own merit, and the credibility that the officer gives each.

But, then again, what do I know? After all, I am just a retarded cop.

And why is the police officer retarded? 3 witnesses with nothing to gain say that the light was red. Your wife admits to driving in violation of a yellow light. Yellow lights do not mean "hurry up and get through the intersection". She should have stayed put and she would not have been involved in the collision.

The officer telling your wife that the insurance companies should work this out was the right call. If you really think about it, you should be taking to your wife about fault. Don't be too hard on her though. It's was a judgment call that she is unlikely to commit again.

Blaming the officer? Give me a break!

Okay. Let's see. You said that your wife thought that the guy was going to slow down and so she made a left turn, right? Umm. She actually didn't know whether he was going to slow down and should have stayed put until her light turned green again. If she says the light was yellow, then the guy still had right to proceed through the light first before her. If the light was red, both of them were wrong to pass into the intersection.

The traffic is horrible in the DC area and I know about being stuck in that left lane. But to be safe it's always good to stay put in the left lane until the green light arrow comes on or when the light is green and there are "no" cars coming.

If you are unsatisfied with the police officer's response, go to the police station and make another request. It's true that insurance companies want to know who is at fault, because there is money involved.

on the scene the cop isn't going to say whose fault it was...they never do because people will hold them to their word even if the insurance company disagrees....the insurance company will be able to tell exactly whose fault it is by the damage to your wifes car. Most likely if all three people are saying it was red, your wife turned when it was yellow and obviously the other guy wanted to make the yellow light as well...its hard to say whose fault it is because the other guy was already traveling on that side of the road and your wife entered into his line of traffic.This is a tough one, wait it out until the adjusters come look at the cars and see what they say! Sorry i wasnt much of a help!

Based on the witnesses saying the light was red it sounds like both their faults, making it a no fault accident. The "one car gets to proceed" is not true. She was in the intersection when the light was red. She ran the red light...just like the other driver.

The witnesses are the key here they reported the light was red, then it was red. Your wife then turn into the flow of traffic causing the crash. Just because the other guy was running the red light as well doesn't change anything.

Firstly, she should have gone when the light was actually on green. The highway code states that the amber/orange light is indication to prepare to go. Otherwise there would be no point having it, it's to give indicaton to drivers instead of lights just suddenly changing from red (stop) to green (clear to go) which would cause much more problems.

If he ran a red light, which you've said was the case, then he was definately at fault also obviously. Technically as long as he passed the white line by those traffic lights before the light turned red then that's OK, but he would have seen the amber light so should have been looking out for others. It would be down to witnesses to give evidence that the light was red as he continued driving past.

Sounds like neither person will admit full blame and it does sound like was an accident from contribution of faults from both persons. n which case it would be up to the two insurance companies to decide on making an insurance payment to either person, unless it went to court to settle.

Yellow doesn't mean go when you get the chance. It's telling you the light is changing to red, be prepared to stop. She should have never pulled out in the first place. She is lucky he didn't write her for causing the crash. With the witnesses saying the light was red they are both lucky neither of them got a ticket. NO the officer wasn't retarded. What an ignorant thing to say.

Well there is someone at fault in this situation. The problem is the guy was going to run the light whether it was yellow or red. See this is what bothers me. People cry and complain about this kind of thing yet they think it's ok to continue through a yellow light or even red. You can't have it both ways. Traffic signals are there to help intersections flow. When people don't follow the rules wrecks happen.

As to your insurance though. Man, be careful what is said to them. They will sell you out in a heart beat. If they call the officer he may tell them what the witnesses said which is was that both parties ran a red light. I don't know how that will affect your insurance.

I'd say it was his fault but if the cop made out a report then i would give it to the insurance company and they can contact the police man who filed the report for more information or they can take it to court

I was involved in a similar situation, but becasue there were conflicting stories (from witnesses as well) and the cop could not determine who was at fault, she gave BOTH of us tickets. I did not pay the ticket, I went to court and was found NOT guilty (go figure). The other party's Insurance tried to get my insurance company to pay for her damage, but they refused. And, get this, the other party's insurance company origanally agreed to pay for my damages, but then changed their mind and revoked the agreement. So, my company paid for my repairs (minus my deductible, of course) My insurance company went to some sort of "insurace litigation" with the other company to try to recoup my deductible for me, but were unsuccessful. Tal about a crazy mess!

My advice: Be glad she did not get ticketed, let the insurance companies handle it, and realize you will be out your deductible. I guess you could sue to recoup your deductible (I suppose I could have, too) but who knows if all the cost and effort would even be worth it.

First, why are you putting down people with diminished mental capacity (retardation)? As to the accident: Even if the oncoming driver had a red light, it was still your wife's responsibility to make sure the road was clear of oncoming traffic; many states require no-fault insurance and this may be the reason a traffic citation was not issued. The officer may have felt both drivers contributed to the accident and, under no-fault, did not issue a citation. Then it becomes the insurance company (s) respondibility to determine fault. How many times have you seen an approaching vehicle with a turn signal blinking, but continue straight? More people need to do defensive driving and obey traffic laws.
