So the Supreme Court's stance is that cops are allowed to ask questions unrelated to why their pulling you over. Lets say your pulled over for speeding... the courts state that cops have the right without any suspicion at all... the right to ask you where your going... what your doing... have you ever had a drug charge.. whens the last time you've smoked... can I search your car... apparently the courts have ruled cops can ask all these questions as for standard routine traffic violations. WTF you pulled me over for speeding theres nothing in plain sight, all my records are in order and your asking me when is the last time I've smoked pot or had anyone in my car who's smoked pot? The courts stay its ok for cops to ask questions unrelated to the reason their pulling you over... no matter what the question or how bad it will incriminate you. What is wrong with our courts why would they give cops the discretion to do this? Then when you say no you can't search my car they use you saying no as their means to gain reasonable suspicion to actually search the car. Im sorry but a cop should not be able to ask to search my car or when is the last time I've smoked marijuana as a general question. This isn't a specific situation, cops have the right to ask this to anyone with no cause whatsoever... the business man in the bently or the average joe in the Taurus no matter how you look no matter what you do.. you can be asked 50 questions none of which are related to why they pulled you over and theres no individual right protecting you from this! What is wrong with our society where we just give a divine power to people with no college education... or 60 credits (AD) a gun and tell them to control society. The majority of cops do not graduate from a 4 year university or college they have their assiociates or no college education... but we'll entrust them to serve and protect soceity as they see fit in some instances with no college education WTF!!! Additional Details Yes and me not answering the question or pleading the 5th... hey look hes acting weird now complying now we have reasonable suspicion to do whatever we want! If the officer is smart enough he can get reasonable suspicion legally on any law abiding citzen just by knowing how to ask the right questions which have no limits apparently.

Since you think cops are so stupid and uneducated, maybe you should go back to grammar school for some basic education. Your use of the word "your" when you should use "you're" and "their" when you should use "they're" shows your obvious lack of education. Try to write something without spellcheck.
The courts have allowed officers to ask questions but they also have allowed the persons being asked the questions to remain silent. In your scenario if an officer stopped someone for speeding and saw something suspicious (bomb making materials, lots of weapons, a body) they wouldn't be able to ask any questions. Get realistic.
I bet you're one of those people that would be the first to complain about the police not doing something if you had something stolen. Well, if you're going to restrict the police from asking questions, guess what, they're never ever going to be doing anything.
I think you're just some bitter person who got caught doing something or were rejected from becoming a police officer. And what is your source about cops not having college educations? You have no clue what the requirements are or have been. Certainly in the past cops were hired for their brawn or if they were one of the "good ole boys" but that era has long since passed. |

anyone can ask you whatever they want not just the cops, its your dumbass misktake if your gonna say hi i just smoked pot, you dont have to answer or tell the truth, and saying no to a search does not give them the right to search it, if they see something laying out they can (or smell something), but that is not giving the cope the right to force you to incriminate yourself, your title was misleading, ever heard one say "you have the right to remain silent", so what if they are suspisious that is not illegal.
its most often the persons stupid mistake for saying things they should not have, anyone can ask you anything but that is not forcing you to admit anything, stop whining and breaking laws and it would be alot less stressful huh |

your an idiot and you need to realize that you don't have to answer them you have every right you do if you are talking to someone else. tell them you do not want to answer that but know that when a "cop" goes back to has patrol car they can see if you lied about a lot of the things you told them and then they have something fun called probable cause and then it no long matters what you say. and by the way if you do incriminate yourself you deserve it. for two reasons one you broke the law and should pay the consequence and two your an idiot for telling the something you didn't want them to know |

I was asked questions like that by a Texas State Trooper when stopped for going 70 at night (it's 65 at night in Texas)... and he was trying to get me to say that I smoked pot or had friends in my mothers minivan that smoked pot and I basically implied he was an idiot and that he was smelling my mothers ashtray...
He let me off on a warning. |

right on. although i couldn't tell you why.
so i get pulled over (true story) for doing nothing wrong.. well, i was smoking a cigarette, and they thought that i wasn't of age, but they wouldn't even admit it. they didn't even want to know if i owned the car, or had insurance. just my ID, cops always make me nervous, don't ask me why..... (don't get me wrong. i know lots of cops, and I've met lots of good cops) and they asked me what i was doing where i was. i told them, and they asked me to get out of my car. ( cant really argue with them) patted me down. sat me in there car. asked me 100 of the stupidest questions. half of them being duplicate worded different. searched my car. and then said i was good to go. think they would even pay for my milk that spoiled since it was 115 degrees out. stupid cops asked me if i smoked ciggerets... after they just seen me put one out. and i had 3 packs sitting on my Passenger seat.... obviously there not very good at paying attention. or just wanted to wast 5 seconds of my life to ask.
and BTW.... if you told a cop no to searching their car. it's their word against yours.. their going to say they smelt something or looked funny.. you know how many cops pull people over for "swearving" when they wernt.. or stoped to talked to people because they looked suspicius.. i understand that some people are obvoiusly up to something. but judging somebody on their apearence. and if your going to give me crap because i spelt something wrong.. get a life. |
