Why doesn't punishment fit the crime anymore?

i just think it was dumb to stop forcing inmates to work in fields, mills, and other positive industries... if working is cruel and unusual punishment, then why do we all do it?

Punishment can fit the crime, but the question is how do you determine what punishment is just and not vengeance for the crime?

If someone runs 1000lbs of coke between Cdn and the US a fair punishment in my books would be life imprisonment. If someone was running 1000lbs of pot 10yrs would be fair. However others would disagree. Someone might say that 10yrs is too long and 2yrs is alright, another might say 25.

Now, lets change to say careless driving+harm w/driving in a snowstorm. Would a LP suspension be fair? Or vehicle seizure? Or fine? Or all three?

How do you address the overall issues as well? Is part of that an issue with the individual, some of it society as a whole? A section of society? Do we arbitrarily lockup anyone who breaks up any law?

because its cruel to put 6 criminals in the same cell, even thou they raped and destroyed children, beat the elderly, left a family with out a father and Raped and murdered the mother of 2

To many do gooders not enough paybacks until some one decides that crime doesn't pay and throws the key away it wil always be criminals before Victims

Because the people who define "crime" are a majority concerned primarily with protecting their own interests.

Let me give you an example:

Someone goes to jail for life for transporting 100 pounds of marijuana into the USA.

Some could argue marijuana is harmless and is only illegal for political reasons.

How do you justify sending someone to prison for their entire life for committing a non-violent act.

My example is very vague but their are hundreds if not thousands of examples that could be presented.

We now use a retributive stance in our courts basically saying if we set really harsh penalties it will deter criminals from repeat offending.

Statistics year in and year out prove harsher penalties are not helping their just making our courts more busy and the recidivism rate is not dropping.

The punishment does not fit the crime because our courts set penalties with the intention of them being extremely harsh with the hopes you won't commit that offense again.

It depends on your definition of "fitting the crime". If your morality is "eye for an eye", then it is because we are more civilized today than in the past, and we understand that that is barbaric.
