and what proof do you have that such a thing exists? Have you done research that shows the percentages of that happening?
I would dispute your assumptions.
You can't even use the numbers of blacks or other races who are charged with armed robbery vs the numbers of whites but only the percentages of blacks convicted of 25 years vs. whites convicted of 25 years. Just would take a lot of research to prove your assumptions and it can't be on the number of each who committed the crimes of the percentage of each who got those years penalty.
Are there larger numbers of actual armed robberies with one race or another? And then what are figures on percentages among the different groups?
This is invalid argument and you get a faulty answer because you have faulty logic. |

This probably isn't always true, but in cases where it is, there are probably two factors involved.
First, whites and Asians tend to have higher income levels than blacks and Hispanics. With higher income levels, they are able to afford to hire a private attorney, while lower-income defendants will go with the public defender. While public defenders and private defense attorneys are technically supposed to be exactly the same, they are not. Private defense attorney's are generally more skilled than public defenders because private attorney's make money based on how successful they are (a private attorney who wins 75% of the time will attract a lot of clients and make a lot of money). However, an unskilled attorney will not make any money at all working privately because it will get around that he loses a lot and people won't want to hire him. It makes more financial sense for a skilled attorney to go private and a less skilled attorney to go public.
Second, if the case goes to court in an area where the population is 90% white, the jury will probably also be mostly or entirely white. They may find it hard to empathize with a defendant who is not of the same race, because they can picture the white defendant as a family member (for example, thinking "this could be my son on trial"), but they cannot picture the minority defendant that way. This may lead to the white defendant being acquitted of the most serious charge and convicted on lesser ones, while the minority defendant is convicted on all the charges. |
