Most likely not if you were not speeding or driving recklessly, but you could be held liable for damages in a civil case. Which means attorney's fee's, lost time from work, and a possible judgement against you for future medical fee's. Are you sure the kid wasn't retarded to begin with who the hell jumps out in front of a moving car to be funny!? |

Your speed?
Did you try to brake?
Did you have ample time to stop when you noticed the child was going to attempt to jump in street?
Drunk?

If it were an accident, the child ran in front of you, and you weren't drinking, under the influence of drugs and weren't speeding, then no. You wouldn't go to jail. |

If you were a legit driver, licensed etc. and it was an accident you will not be sentenced to jail in the US.
Just after the accident there is a chance you may spend a little time in a lockup or secure facility likely less than a day, but not go to jail.
An accident is an accident there is no intent or implied intent. Intent is needed to prove you committed a crime. |

Not a whole lot of information to go on, but if it was an accident on your part probably no jail time.
Now if your state takes it to trial, then they think it is your fault somehow and not an accident, and they are going to try to prove it is your fault. If they do prove it is your fault, then, yes jail time & fines.
Whats more, even if the state does not file charges the child's family can still take you to court civilly. Then it would be up to the child's family to prove you were at fault somehow. If they prove it then it would just be fines, & no jail time. |

It would be entirely up to the court and what sort of case you presented. If the police have charged you with driving in a wreck-less and dangerous manner, or driving under the influence, would all be considered. If the accident was nothing more than an accident And you were paying due care and attention whilst you were driving and it was an unavoidable situation, then the likelihood of you going to jail would be almost Nil.. It is entirely up to the case the police present and the judge who hears the case. Hopefully you have a lawyer. |
