Will i go to jail if there's death in the accident (not my fault)?

last year July2008, i was driving a car (i was going straight) n suddenly the bike come out from the left road without looking, n he blocked my way, n i couldnt break on time n hit on him. based on the hospital report, he only fracture his left wrist n right ankle.

but today i got an letter(from a lawyer that his wife wants me to compensate) that he had passed away on spetember2008 after 2 months of accident, which is more than half year ago from now.

but what i am thinking now is, will i go to jail although it is not my fault? when i report police, the police dint say anything, they dint give summon. is that means they r still investigating the case, or is that means i wont be going to jail??

Jail is not a consideration unless you did something wrong legally, like speeding, etc. Call your insurance company and let their lawyer take a look at the case. I think you should be fine.

check your insurance and call a lawyer. this sounds like you are about to be sued

You need a lawyer. It sounds like, although there were no charges made, the wife/widow wants to claim on your insurance. This is a Civil matter and might lead to a lawsuit $$$. But I don't think it means jail for you. See a lawyer.

Sounds like a scam.

See if you can get a copy of the police report, and talk with the cops that investigated the accident originally.

The police would have to tell you they were still investigating the accident, just ask them to confirm that no proceedings are due against you.

Play safe, go see a lawyer who specialises in traffic court cases, he may be able to get all the facts through his police contacts.
Don't reply to the lawyer's letter until you know the facts

I would agree with the person that gave the first answer.
If the accident report shows the other person to at fault, no you will not go to jail.
However, you DO need a lawyer for a possible civil lawsuit aginst your insurance company and you personally to defend that your actions did not cause the accident and furthemore that the deceased person's actions were the cause of his injuries and later death, IF the death was from teh result of the accident in the first place.
Also, I understand what the hospital report shows, however there could have been aditional injuries that were not caught by the medical staff at the hospital, thereby opening the window for a medicl malpractice lawsuit against the medical staff.

hmm my two cents:

if his death had nothing to do w/ the accident i doubt u'll go to jail. if they found he (rip) was in the wrong by riding his bike in front of a moving car, then u shouldn't have to pay either.. this country is full of frivolous lawsuits.. get a lawyer and counter sue for slander (or something like that)

Somebody has to be blamed so guess who.
1. get a lawyer, the law states you have to have a justifiable claim, this does not add up as a justifiable claim.
2. The accident has to be a direct result of his death.
3. negligence can be fund on his part and as long as it is there is no case to file (Contributory Negligence)

Good luck, I highly doubt this would even go to court. Your insurance co may take charge of this case as a third party.
