Wondering if police violated my rights?

so about two years ago my dad took our family out to eat at reno and we were coming back from a trip from reno. on the way back my dad pulls into Uhal to and then goes to walgreens, well all of a sudden a police man flashes his lights. moments later about 5-6 more police cars come and circle us around. they all of a sudden pull there guns out (shotguns and everything) and tell us all to get down one by one. they then put us in handcuffs (without telling us what we did wrong just put us in handcuffs). they had pat us down. then they ask for our names(were we obligated to tell them our names?). then they explain a story that some truck( that was similiar to ours) had did an illegal shooting from an ak-47... i was just wondering what were my rights and did they do anything illegal...

It is amazing how many people are ignorant of their constitutional rights(eight so far). No, the police did nothing wrong. In fact, it sounds like they did everything by the book. They surrounded what they reasonably believe was a heavily armed group of people, secured them, identified them, and after realizing they had the wrong people, they promptly explained what was happening and let you go. It sounds like they did a great job even if they had the wrong people.

Yes you have to identify yourself when asked. Why wouldn't you. Unless you are wanted it will make things easier on you to cooperate.

What do you think they may have done that is illegal? Or are you just spouting off. May I suggest you and the other people on here who lack a basic knowledge of what your rights are take a law class?

they did not violate your rights, they patted you down and put you in handcuffs for their safety

No, they did not. They had reason to believe you might have had a weapon in your car (since your vehicle looked similar to one they were hunting). They handcuffed you for the safety of the officers, same with patting you down. You are required by law to provide your name/ID for an officer if he requests it.
The officers did nothing wrong.

While this was inconvenient and most likely scary for your family your rights were not violated. You were in what they considered a suspicious vehicle that may have been involved in a serious crime. The officers first priority is theirs and the publics safety so they approach with guns drawn and put you in cuffs. Keep in mind they do not know if you are the ones with the AK or not.

The police had "probable cause" since the truck matched the description. The only way they may have violated your rights is by not telling what you were being arrested for and, depending on state law, your name. My best advice is to just let it go if you weren't charged with anything, but if it is a concern, consult an attorney.

By the sound of it no not really. I was pulled over in Miami once because my car matched the description of a stolen car. However, the officer just asked for papers and explained why, no guns, no cuffs, but your case did involve a gun. So, I think it's safe to say they have the long end of the proverbial stick on this one. Pun intended.....

They were doing their job, don't wine about oh someone violated your right's okay that's everyone's problem these day's, everyone wants to sue everyone about oh they violated my right's when really their just doing the right thing, not violating anyone. i mean yeah it would be frightening to have police do that but they were playing it safe making sure you weren't a crazy bunch lighting people up on the street. and if you were that person than hey they bust a criminal, if not like they did oh well they were making sure, if no one got hurt physically in your family then don't put anything against the police, that's their JOB! If they started unloading or beat up on you guy's then sure they should be in trouble, but if they just wanted to identify yall then no right's were violated. We've got criminal's/Terrorist getting off the hook because "Someone violated their right's". When someone tries to protect the good from evil, evil gets off and good get's in trouble, help stop it.

The police had the right to do all of that if they did have a report like that. If there was no report then no they would not have the right to do that. You can ask for the call logs for the call or report of the incident becasue the freedom of information act. If this was two years ago they might not have it any more.

No, it was totally illegal. They weren't allowed to do that. They cannot cuff you for that reason. They can not pat you down for that reason. Your rights were violated.

Sorry to tell you this but as far as cops are concerned they are the only ones who have any rights. Cops just piss on everyone elses rights.

yeah, they should have told you your miranda rights, but since after it was safe to them they did follow through with telling you what you were being accused of... it was the part where you could remain silent and anything you said could have been used against you in a court of law that they forgot.

Your 5th amendment rights werent completely violated.. but if you felt that they were, theres nothign you cna do about it.. besides that was two years ago? your memeory probably isnt what really happened completely.

i was in my car and i was warming up my wife car i had my lights on and my wifeights on so the police pulled up in the lot they pull up to the car with their guns drawn at me so i got out then he pull og my belt and started searching me he was all in my balls telling me to open my butt chicks squat i really felt violated can a cop search me like that and he didnt even put me in cuffs what rights i have
