Would this be a misdemeanor or felony?

BURGUNOCCSTRUC/CV OR ATT., and can this be cleared off of someone's record after they are 18?
My boyfriends hoodlum brother wants to move in w/us, I'm pretty much being the bad person by saying no (he has stolen money from his own mom, robbed his own child's piggy bank to buy drugs,over dosed in the past, etc) . I really don't trust this guy. His brother said that this offense is no longer on his record, and he can easily get a job (which he's never been able to hold a job down before, maybe like a week, lol), is he telling my boyfriend a lie, just so he can try to move in?

Oh and this offense happened in 2006 after he was 18, public records says he should still be on probation till 2010, but he says he is no longer on probation.

Where did you get that information? It looks like 'Burglary of an Unoccupied Structure' - not sure what the 'CV' means, 'ATT' possibly means 'attempted'.

Most burglaries are felonies. I'm not sure if there are any misdemeanor sections for 'attempted' burglary in any other states. The exact length of his sentence (including probation) would depend on the exact charge, the laws in the jurisdiction in which he was charged, and possibly the Judge's decision (although in some cases the sentencing is mandatory rather than discretionary).

well public records dont lie... and if it was after 18 it is still on his record under 18 even felonies can be hidden under the minors rights laws...

A conviction after their 18th birthday is on their record Forever.

You can call to confirm his probation status. I really doubt that he's been released from probation. Contact the probation department in the county in which you think that he's on probation from.

You may need to dump the brother, the family and ultimately the boyfriend.... this guy sounds like he's bad news.

It sounds to me that your boyfriend doesn't have any respect for your wishes, therefore, he has no or little respect for you. The record wouldn't go away unless it is expunged by a court order. It isn't likely to happen unless it was found to be a wrongful conviction or it has been a long time ago.
If he steals from his family he pretty much has shown he respects nobody. Your boyfriend is living in denial.

You're right for not letting him move in. He could have paid for record expungement, which doesn't clear the record, it just hides it from employers and non-law enforcement searches. In your case, does it really matter? He will rob you blind to pay for his habit because all a drug abuser can think about is how to get the next high.

By the way, drug abusers develop the ability to lie while sounding very convincing out of necessity. Like I said, all they can think about is how to get high again. Don't believe a word. He's probably duping your boyfriend, and once he's in the door, it's over. I know it's your boyfriend's brother, but you have to stand your ground. If he lets his brother in, there's a really good chance that the hoodlum will bring drugs into your place, which you will be legally responsible for. If that happens, pack your stuff and get the hell out of there.
