for prom me and 16 and of my friends decided to get a streach hummer limo to ride in. we paid a 500 deposit to our one friends mom so she could put it on her credit card. well a few weeks later a few couples dropped out and we decided it would be to much to get it and we decided to lose the deposit. the girl we used her moms credit card transfered our money behind our backs to get a smaller limo with a differnt group of friends. do we have a chance in court for any type of refund?

this is just going through the towns district majristrate. also we do have people who wrote a check so we have proof we gave her money

You have to sue the mom for being a scammer that's what I call it.

You did make a verbal contract as both sides presented consideration (You with the 500$ deposit and her with the usage of credit card and contracting of the service), and since you are both minors you can disaffirm any contract you make, so in effect you have a good shot of getting judgment in your favor. |

That would be civil court rather than criminal, and with that, you have to pay the court fees. Not only that, but you're going to have to pay for a lawyer (you're probably not going to try the case yourself). Lawyers can cost anywhere from $75/hr to $200+/hr. So for what you're going to be suing her for, and what you're going to have to pay out, is it worth it to even try? |

not really since there was no contract between you and the mom. also just to file a lawsuit would cost around 100 to 200 dollars, so u must ask yourself is it worth it? |
