If he moved his hands I would assume he was raising a weapon and shoot. I would not wait to find out if he was armed or not.
By the way, my wife is an excellent shot with her 9mm. She practices once a month with a group of women. They all took lessons and have practiced in real conditions like low light and lying down as if awakened in bed. |

That's one of the reasons I have guns. Everyone has a gun in my state has a gun and 'rashes of burglaries' don't last very long here. |

Common sense says you'd shoot him if he was armed.
In California, you can't shoot on sight; you can be charged with second degree murder/manslaughter. You have to be in immediate danger of your life. If he's just taking things, I'd let him, but I'd be on the phone to the police while I have him at gun point. |

If he breaks into my house, I don't know if he has a weapon or not, if he is going to shoot or not shoot, but; I do know that person will be going out on a gurney wagon, with a sheet over his head, DOA. |

No, I wouldn't shoot him if he put his hands in the air. It's illegal in my state unless my life is in imminent danger. You can only defend your LIFE or the lives of your family and since his hands are in the air and he doesn't have a weapon, our lives wouldn't be in immediate danger, just our possessions.
But if I knew he had a weapon and/or he tried to use it, oh HELL yes I would shoot. |

I'd shoot to kill regardless if they're armed or not. Breaking into my house would be the last bad decision a robber makes.
And I wouldn't want to live anywhere where it wasn't legal. |
