i know its 3 years, but is it 3 years from the date of the ticket or the date you pay the fine on the ticket?

I believe Bruce is incorrect. The applicable statute is Veh C 12810, which establishes the points used by DMV. That statute defines points in terms of "convictions," which would lead to the conclusion that the 3-year period in which the points might be counted runs from conviction to conviction, not citation to citation. You are convicted when you pay the fine (actually, on the appearance date after you pay the fine). I must admit, though, that I cannot find a statement confirming my reading of the law either from the DMV or in any judicial decision. |
