a arrest was made in march bail date april then moved to end of june can they keep changing the date ? how long can they keep doing this for, and once bail has been answered and if no charge is given can then re arrest in conection with the alleged first arrest ?

no it is police bail no solictors or attorneys, and arrest was in connection with an alleged offence, the bail is to return to the police station, to either be discharged in conection or charged yet they keep moving the date ! so how many times can they do this ??

The police have a certain amount of time before they have to charge you, and each time you visit the station that time is used up a little. Police bail is used for ongoing enquiries into an alleged offence, but for which they do not yet have evidence to charge. There must be a reasonableness attached to the process, and some offences have a time limit (a charge for Actual Bodily Harm must be made within 6 months of the alleged offence, for example). Each time you report back you have to be re-arrested for the crime, as long as the power of arrest is still in force (if enquiries reveal your innocence, then obviously you would not be rearrested, you would be released).
The police need to be allowed to get on with the job, but if you think the extension is unreasonable I suggest you speak to a solicitor who can contact the police on your behalf and put some pressure on them, but then a month extension does not seem unreasonable, depending on the offence. |
