I am looking for clarification on the following issue: Two young people under 18 are out shopping in a city in Ontario. Without the knowledge of the second person, the first person takes two items from a store without paying, then once outside the store, gives one of the stolen items to the friend. The first youth is apprehended by store security and the security person subsequently approaches the second youth and calls the second person an accessory to theft. Store security issue written notice to both that they are barred from store premises for one year. The police are called. The one who committed the theft states takes full responsibility and informs police that the friend had nothing to do with the theft. Nonetheless, the police issue a formal warning to both young people, informing that they will both be cited in the official police incident report. Should the innocent young person /that young person's family pursue further discussion a) with the store to have the trespass notice revoked and b) with the police to have the innocent young person's name removed from the police record? If not removed, how long does the innocent youth's name remain in police records.
