I was recently arrested for a dui for the first time in my life and is seems the cop lied about every aspect that really did happen. he wrote everything to make it seem like it was tens times worse. he also said i was chewing a large fresh peice of gum but then 2 sentences down it say i could smell alcohol coming from the subjects breath.. what the hell is going on right now? Additional Details I was not chewing gum, the police officer decided to write that in for some unknown reason.

They lie to make you out as a criminal & they are so indoctrinated into it, that there are times they no longer realize they are lying.
Drinking & driving is bad news; gum will not mask alcohol.

Most people think chewing gum masks alcohol...it doesn't. They foolishly try and hide their alcohol-breath using gums or sprays, but cops can smell right through it. He didn't lie. Experienced cops can smell even one drink through your Bubblicious. Chewing gum with alcohol-breath is also evidence that you knew you'd been drinking too much, and were trying to hide it once pulled over...and definitely should be in the report.
Sorry about your probable conviction, but this just illustrates something even more important: Most people do little things that seem harmless, just to save themselves the hassle of arrest, that demonstrates their actual guilt. The police do every thing they can do document this behavior. |

Were you drunk and driving? If yes then what else matters?
So he said you were chewing gum, that makes no difference in the test results, and you can still smell alcohol on a persons breath with him or her chewing gum (People try to do this all the time) what matters is what your BAC shows.
You got caught DUI, now it is the police officers fault, he did everything wrong, he lied, he made things up just to get you.
Bottom line the court will go by what the BAC test results were, what ever else you say (and we have not seen what he put in his report, only what you are crying about here, which is your perspective only) is not important to the case |

Did it ever occur to you that you were drunk and don't remember most of what happened? The fact that you were chewing gum has nothing to do with how your breath smells. Its an urban legend that if you pop gum into your mouth when you are stopped that the odor of alcohol will not be detected. |

Generally I wouldn't comment. However, it is against the law to file a false police report. It does not matter if it is a cop or a civilian filing the report. It is illegal.
You should bring this up with your legal counsel.
(Try and make a deal. Also, no more drinking and driving. It is way too dangerous.)
I do not agree with anyone driving under the influence. It is reckless and sometimes deadly.
You, however, are not sworn to uphold the law. You have not been given a badge and a gun for you to use to protect the community that you live in. I stronly believe that law enforcement must be held to a higher standard. |
