6th Amendment Question?

Just a quick question about the 6th Amendment to the US Constitution...what does this phrase mean?

"to have the Assistance of Counsel for his defence"

Haha, that's EXACTLY what I was thinking too! But it turns out it DOES say defence. Don't worry, I'm a crazy speller too. :D

You have the right to an attorney.*

The Supreme Court has interpreted the right to assistance to be limited to criminal trials. The right does not formally begin until the first substantive appearance in court. You do NOT have a right to an attorney before then, unless you are being interrogated and request one. However, they don't need to give you the attorney, they just have to stop interrogating you.

The right to counsel only applies to those who can not afford a lawyer. If you can afford one, you have to pay for one of your choosing.

The right also only applies to criminal defendants who actually RECEIVE a sentence that includes jail time. This means the judge has to decide at the outset whether he is considering sending the defendant to jail. If he decides no, and denies the attorney request, he can only fine the individual or sentence to probation.

The right has been recognized to extend through the first direct appeal (normally the intermediate State court) but not after.

Lol I'm sure it says "defense" not "defence".

It means that one has a constitutional right to the assistance of an attorney. This is part of the basis of the famous "Miranda" warning "you have the right to an attorney..."
