A friend was hit by 2 motorcycles rolling her truck and putting her in the hospital. its was 4 am,?

and we fear she had been drinking. she has been released, but if the accident wasnt her fault can she still be charged with a DUI? no charges have been posted as of yet.....

boots.... the friend was on a turnaround (two way road with island in the middle) and the front wheels of the truck were turned giving the force of the motorcycles that broadsided her more leverage. this is one of the factors that helped cause the flip, but the motorcycles had to have been going in excess of the speed limit which I believe is 40 where the accident occurred. highly unlikely to you or not, that's exactly what happened and it took the paramedics 45 minutes to extricate the driver from the vehicle because it was so mangled.

Yes she can be charged with a DUI. It does not mattered who caused the accident. It is illegal to operate a vehicle under the influence of drugs or alcohol

If they tested her and she was over the legal limit, she will definitely be charged whether the accident was her fault or not.

Yes, she can. One has nothing to do with the other. Also, if she were charged with a DUI she may be responsible for the accident. She should not have been behind the wheel of the truck. BTW, I find it highly unlikely that 2 motorcycles can roll a truck over.
