This is one of those tricky things that do kind of wander into a legally and ethically gray area.
One one had we have a country that believes in the validity of western medicine and it's capabilities, and laws that protect people who would do themselves harm. One the other we also have a country with freedom of religion, and some ability to truly practice your own moral beliefs without interference from the government.
Theoretically the doctor could have only gotten such a court order if the blood transfusion would have saved the persons life, and the lack of transfusion would have killed them. In this case you have medical science and personal decision laws when the person is a "danger to others or self" warring with freedom of religion laws. If, in every other manner the Jehovah's Witness has shown themselves to have mental competence, (weather or not you agree with their beliefs) then I think an adult should be allowed to make that decision.
When a doctor says "you must get chemotherapy or you will die", we do not force them to have chemo. And really, though less cut and dry, it's the same thing.
If it's the case of a minor child, then I think they should be forced to have the blood transfusion. It may go against their beliefs, but this is also the government in which they live. And, for example if you're beliefs include NOT sending your child to school, then the state will take the child and educate them.
The fact is the adult will also be forced to have a blood transfusion. There are far less legal ramifications to forcing someone to have a minor procedure that will save their life than letting them die for want of the same procedure. |
