yes. legally they get charged w murder. |

It's homicide. And I'd imagine that any DA with political ambition (which is all of them) would charge the person. |

Legally, yes. Except for self defense only the state can kill. |

Knowing our laws, yes they would, unless it was self defense. |

yes. For that means that the family member are capable of murder andare therefore a threat to society |

Of course he would be charged with murder... An individual is not legally empowered to kill another individual unless it's selfdefense. |

Why should the government beable to avenge the death of someone they didn't even know? Doesn't it make more sense to allow the mourner to avenge the death of a loved one? Why should the mourner get charged with a murder that the government was going to do anyway? What makes the government think that they are above the law? Wouldn't be cheaper on the tax payers if the mourner did it? Those are just a few of my questions about legalized murder. |

The death can only be issued, and followed through by the state. Killing someone is killing someone and unfortunately for the family of the victim would be tried and charged. Depending on the mental state of the person who committed the act they may be lenient. However the state doesn't want a bunch of vigalantes running around so they may have to make an example of them. Most of the time, if the man is going to be put to death the family feels justice is being served. |

I guess by law it sounds like yes you do. Although by common sense it sounds like a waste of money to do so. I bet a judge could rule on whether to take the case to court, and nix the stupidity. |

Actually in the legal setting you do. |

Yeah whether or not he was sentenced to death because it becomes the state job to kill the man they want to kill him.If you don't charge the family member with murder that will be an injustice for the dead man. |

Do you mean a family member of that person? Or maybe of his victim?
If a man is about to be put to death...odds are it would be in a prison setting. There is no way a family member could gain access to him to accomplish this. So, there is no answer for a situation that would never happen. |

Yep. Know what's good about doing that though? Seeing as how they're already set up for an execution you won't have to wait long for the chair!
