The person who signed for it clearly saw that it was not his or any of his roommates, but rather thought he could get away with getting a free gift. I'm working on getting in touch with the person who has it, but is there anything I can do legally if he denies, refuses, or says he doesn't have it anymore?

I would contact the company that delivered it, and either two things will show up. It may either show up that he signed for it, and then you can put in a dispute with not only them but with the company that you bought the product from, and they should send you out a new one, Or it may show that he forged your name to get the package, and therefor the signature won't match up with yours and you can dispute it that way, because forging your signature is illegal. |

You have good legal recourse. Provide a copy of your new lease and a copy of the signed delivery sheet to the sheriff's office and they'll be able to check it out for you. Otherwise, it's on to small claims court..... You need to prove you had moved and weren't at that address when the package was delivered. |

Absolutely, Opening someones mail is totally against the law. Now if the person signed for it, then there should be a document with their singnature. If its UPS its pretty easy to track the package and the signed paper. I would take that and call the police. Don't confront the neighbor alone. Small claims is your final option if all else fails. Yeah, call the police and ask them how you go about getting your goods. And if the person uses, ruins, or destroys it, plan on taking them to small claims court to get the money you will be due. |

If he denies having it, contact the sender to let them know. They contact the carrier (UPS,USPS,FedEx) who will issue a tracer. They will send the delivery driver out to follow up with the person and shows them a copy of the signature who signed for it. In most cases, they will turn the package back over to the driver. If this does not happen, a claim will be issued by the carrier company if insurance was taken out. |

Yes. It's called mail fraud and depending on the value of the parcel, robbery. You could also try to get the person for identity theft. |

You can take him to small claims court for the value of the property he received. Just be sure that you have the necessary evidence before you go to court. A letter from attorney also gets people's attention, but that will cost you. |

You can contact the company that delivered the package and tell them the facts and that it is not your signiture.
almost all company's will replace what you ordered. Until you do that I would not have any contact with the person who signed for the package.
You can also call your Post Office and tell them what happened that someone else illegally signed for your package. |

Contact the sender and let them know what happened. Also contact the post office. That is a federal offense that isn't taken lightly. Notify the police as well. Legally, you can do a lot. They stole your mail. |

I once moved inthe summer before my tax refund was sent and I filed with the post office for mail forwarding after the period of time it takes to complete such a change. Needless to say my refund went to the old address and a tenant took it and used their friend who worked at the local cheque cashing place to cash it. It was a lot of money and although I called the IRS and some federal agency got involved too, nothing became of it. You would think something like this is cut and dry. They took my refund, cashed it and a place that you know where it was cashed and took my money... right? It is amazing how hard and eventually futile it was for me to hope such a thing was possible to resolve. 5 years later no resolution. |

if you know the tenant took it, get an invoice from the place you boght them with a "delivered date and time" then tell the police that they took it and have a copy of the delivery. this guy pretty much signed his *** to jail! LOL! thats it. because he signed it all you need is the invoice with your name on it. he's fu--in screwed! go bust his ***!

Was your name on the package? That is going to be the clencher in this case. If the resident signed for it, then that signature is on file with the carrier (UPS, USPS, FEDEX, etc) as proof of who accepted the package. If your name was actually on it then you have a case and will need to begin with contacting the sender. They will probably need to sign an affidavit stating how they addressed the package. Depending on which carrier was used (if it was USPS), it is a felony for someone other than the addressee on the package to open it. Get the affadavit from the sender first, contact the carrier to get a printed copy of the signature (you can sometimes just get this from their website), then approach the authorities. Good luck! |

Yes you can get ahold of whoever delivered it and you can make them reeburse you for the package. They let an unautourized person sign for your package. Accordingly they will probably go after the person who signed for it. However, if the person signed YOUR name you can take them to court for identity fraud. Either way you can get your money back for your package! Good luck! |

it's illegal to tamper with the US mail.The mail person should not have left the package,also the tenanat should have refused delivery , because he was aware that you were not there. So if it is something important (or just something you want back) of course youcan pursue it legally . Or maybe just ask. He/she may do the right thing and just give it to you. |

I've signed for things assuming my wife ordered them and not bothering to look to see who it is addressed to. I've also been in your situation where I ordered something that showed up a couple weeks after I had moved out. I left them a note asking them to contact me so I could arrange a time to pick up the package and things worked themselves out. You could try that route first. If not then you might have to get the police involved. |
