All marriages must be registered: SC?
Find answers to your legal question.

All marriages must be registered: SC?

The Supreme Court on Monday held that states must take steps to register all marriages in all communities. The order can annoy those among Muslims who insist that such legal requirements infringe their right to be governed by their personal laws in matters of marriage, divorce and inheritance.
Reiterating its February 14, 2006, order, the court said, "We are of the view that marriages of all Indian citizens, irrespective of their religion, shall be compulsorily registered in the state within whose territorial jurisdiction it was solemnised." Your comments .

The Supreme Court decision should be complied with immediately because its aim is to protect the marriage to some extent. Muslims should not have any objection to it. The only one fear for Muslims for registration may be that the repeated registration of marriage may cause some embarassment for them as they are not normally satisfied with one marriage. That is the only one infringement regarding their personal law. Moreover we are living in a secular state having all freedom as given in the Constitution, no personal law should override the enacted law/rules. So instead of annoying themselves, they should welcome the decision of Hon.Supreme Court because in the guise of this valid decision, they can take effective steps for a golden tomorrow.

India is a secular state.... it doesn't patronizing any religion All the religions Is same in its view... though is gives some specializations. But supreme court is not like a political organization... We must not blame or feel annoy with its decisions... whatever the decisions are taken by the courts are not dependent on the politicians... If any one doesn't have respect in indian constitution and its laws it means.. They are insulting it .. It is better to not stay in... It is not good to say about a separate community... It is a old dialog... Tell me one thing.... Is allowing Muslims in India for multiple marriages is good.???... This is getting worse on indian culture... restriction on Hindus for one marriage and free for Islamic is not good... The politicians are making the word secular a worse....
In reality Secular means .. What ever the constitution law is in its execution all the communities are same. Law is made independent of religions...

The supreme court have it owns power to make things in order, like any other religions. human right or religion right must. must remind the stage if it is wrong in the sign of GOD but not because of any right.right have limited.if the supreme court see that his right must bring equality to all people, then l support the desicion from the supreme court but if it not for all then supreme court may bias and may wrong in his desicion.

What is the problem other than effective implementation for which sub registrars of Marriages will need to be set up in every taluka and gram panchayat , or a competent authority will have to be appointed for this purpose in these areas, to facilitate registration. Muslims who can afford multiple marriages, as permitted by their personal law, will merely have to register each marriage. In any event, all those seeking spouse visae in the Gulf, including Muslims, are doing so at present as per statistics from the office of Registrar of Marriages at Old Customs House in Bombay.

This is a leading Q, in legal terminology. The Q itself is the A.

So according to SC, it is responsibility of the State to register all marriages!!! Is is not interesting that SC does not make responsible persons who solemnize marriage!! There is no reason for muslims or anybody to get annoyed by this order. It is like maintaining statistics.

yes its a gr8 judgement, and we all citizens must welcome it,all people hindus muslims christians sikhs, and all others, there should be no excuses,i dont no the exact judgement, but i fell the court must put an deadline for raising the required system for registration of marriages.we people register our house our vehical, our birth and nobody has any objection.then why should people have objection about marriages, nobody should get any excuse on basis of religion or caste.its now the responsibilty of state to implement it and provide staff for this job.

Indeed an excellent decision.
But as usual, Miyabhais say ' hamari murgi ki ek hi taang." We wont obey. They assert that it is interference in Islamic teachings.

Registration of Marriages. Could some one tell what it will solve. Things will be the same whether the marriage is registered or not. Otherwise also there are are plenty of legal enactment to save marriages, but ineffective.

What country?

If you're talking about the US, then it doesn't matter what the South Carolina Supreme Court says -- you cannot regulate purely religious activity. So, if a religion declares two people married -- and they are not asking for legal benefits for that status -- the state cannot compel the couple to register that religious ceremony.

If you're taking about some other country.... never mind.
