My husband filed for divorce Friday but today he was giving off the "I want to sleep with you still vibe". Then he backed off when he thought it was making me uncomfortable. If I slept with him will that hurt his chances in court as far as getting a speedy divorce? He said we can be divorced in 60 days and I am looking for an attorney now to respond to his petition. I wanted marriage counseling so we can deal with issues regarding his parents (who ultimately contributed to the marriage ending). I know that if he wants a divorce he will get it. I am a christian and I do believe married be should be married unless it is abuse or infidelity.

Can a judge order marriage counseling before dissolving a marriage if that judge sees fit? Will it be a big mistake on his part if we slept together? I am not looking to trap him into doing or anything like that I just want to know the ramifications in the actions...Btw we just found out we're pregnant...I'm 9 1/2 wks and we live in TN.

Thank you Ice. I kinda figured that. But I will definitely shoot for a mediator. I really don't think the marriage is over..we just have to address the issue that we are having and the weird part is I think he is afraid that it just might work. He cries a lot over the situation and he keeps his wedding ring in his wallet. I asked can I have it in memory but he told me no he it needs to stay in his wallet. Makes me sad too because we had a really great marriage until we had a falling out and we said some hurtful things. Fighting shouldn't have us to this point.

It depends on TN laws. Most state require a minimum separation period with no co-habitation. In the state I live in, if you slept with your husband after he filed for divorce it voids that filing. He must re-file and start the waiting period over again. The judge can order whatever he or she wants, mediation, couples therapy, etc. The fact that you are pregnant will more than likely make the judge reluctant to dissolve the marriage right away. Also, you can fight the divorce and that can make it take much longer than 60 days. You and your lawyer can request mediation or therapy as well.

Shoot for marriage mediation. Cheaper than an attorney, though attorneys are often the mediators. A judge will not order counseling, although in some states the attorney is required to tell you that you have the option of mediation.
