When you are hired, you are entering into a contract with your employer. If a section of the contract states that the employer will pay accrued vacation pay, and there is a clause that states this section will be prolonged even after the termination of the contract, then the employer is legally obligated to uphold that section on the contract.

If you have no such contract then, the employer has no obligation. Unless you sue him in court that you believe that he implied to you that he will uphold such obligations. Its difficult to prove, but if you are successful in proving that his communication to you can be understood by a logical person to imply such obligation. Then it will be a verbal contract and can be legally upheld by law.

Vacation time is a benefit of your employment. If that employment is terminated, your benefits are forfeit.

Generally speaking I would think so, but it depends on how things were set up when you were hired

Vacation pay is deducted off your earnings, it is not there right to withhold it. Unless something is different in america or where ever you are. Any time i have quit a job my vaction pay was added to my last pay check. They dont just "give" you 2 weeks pay, they take a small percentage from all your yearly wages and put it in a fund for your vacation pay...its your money and you earned, tell them to pay up or your getting a lawyer because its against the law to not pay theyre workers.
