i am being accused of a crime i didnt commit. and none of the other suspects are being asked any questions and have refused lie detector testing. should i refuse as well

If it can clear you, take it and let your lawyer worry about getting it in.

Lie detectors have no real scientific basis, You can flummox a test simply by tightening your sphicter muscles and doing stuff like holding your breath. It's not difficult.
A lie detector detects things like heart rate, blood pressure etc. But if you are already nervous then the test simply shows that you are nervous, and not neccesarily lying.
Your lawyer should simply dismiss the request, dont answer questions without a lawyer present, even for a 'chat' with the fuzz.

Lie detector tests are inadmissible in a criminal court, but they are often used by police to eliminate people who are suspected of committing the crime.
I would not advise somebody to take a lie detector test before having a consultation with a criminal defense attorney. It is best to go into the process fully aware of everything that is going on. |

They shouldn't be. According to what I've been taught in my psychology classes in college, they aren't even accurate. They test for things that "can" signify dishonesty, but have many other explanations. I was asked once to take one, and they told me I failed it, tried to brow beat a false confession out of me, then after a week or 2 later they told me(left me a message with my parents I didn't live with) that they didn't have a case, and they were not pressing charges, etc. The problem with the test is they quite often will say you failed some question, and try to get you to say something that they can use against you. I can tell you I'll not cooperate with one again. Theoretically they leave you alone if you pass, but I found the process abusive. It's a hard decision. They should not be admissible however. |

They are no longer admissable in court cases, due to the fact that they aren't ever 100% correct.
You should take it, (if you really are innocent).
Lie detector tests judge opinion based on heart rate, pulse, speed of breath, and level of perspiration. This is assuming that everyone is exactly the same, i.e. everyone will get nervous and have a higher pulse when lying.
For someone with a panic disorder, or anxiety, or any normal innocent person who's nervous and afraid to go to jail for something he didn't do, then obviously you'll be sweating and your heart will beat faster when you hear a question related to the crime.
That's why it's not admissable in court.
I don't know if you should take it or not, that's really up to you, but that's just the information I know, and hopefully that helps you out. |
