If someone smokes pot, and a cop stops them on the side of the rode and suspects they have done so, can the cop arrest the person, or do they have to have concrete evidence? By "person" I mean "teen", if that effects your answer.
Additional Details
Just another detail, I am assuming this person would not be under the influence. They would not be high, they will just show signs of being high recently (dilated eyes, strong marijuana smell, etc)

If the officer detected the odor of weed, then he has sufficient evidence to detain. If he judges the person to be impaired, he can detain and/or arrest. The charge might not stick, but I think that officers do this to teens to shake them up a little bit. As long as the officer doesn't break the law, I think it's a good thing which has probably scared more than a few teens into reforming their ways. |

If you appear to be, "under the influence," they can, just as they can if your under the influence of alcohol. |

If the person shows signs of being under the influence of a controlled substance, there is enough to justify an arrest. It is against the law to drive under the influence of any controlled substance, including marijuana. |

In Canada, you cannot be arrested for suspicion of smoking pot. I do not know about other countries. |

what is the charge? i dont know of one. all they can do is call your mom. if they charge you with something go to court and fight it there no evidence of you bein high is there did you act all crazy if not you should be good. but in some states you can get an OUI for driving while your high but ive never heard of anyone being charged with that when i was younger my friends and i got pulled over we through the roach out the window they had dogs come and they searched the car but found nothin they had to let us go.well if your on probation they can get you tho |
