It may be legal, but you wouldn't be respected. So even if it is legal, you might get fired.

I reckon, due to stereotyping, that would be classed as indecent conduct and the man would be sacked.

Well as a woman if i turned up to work in a mini skirt and heels I would be told to go home and change for appearing unprofessional. There are no discrimination laws relating to cross dressing so unless this intefered with you role or fell outside the company's dress code then dismissal would amount to unfair dismissal.

I'm sure in your Judges manual/handbook under appearance it says like slacks and button down shirt. Doesn't say anything about a dayum skirt. I would honestly ask you to recuse yourself.

As a judge (if indeed you are one) you should know the answer to this question.

Theoretically, you have a fundamental human right to wear what you like to work.

In practice, however, it's a different story. Besides, do you think anyone would take you seriously if you turned up in court in a mini skirt and high heels?

If you were a judge then you would certainly know where you stood as far as the law is concerned. If the particular employer had a dress code and the person employed there signed a contract then I am sure this could be enforced. Another question one would ask is; Would this particular mode of dressing cause offense to the customers, assuming this person works where the public were served. Would the person who employs that person lose custom because of the mode of dress. If the answer to these questions were no, then it might be difficult to terminate the employment. I think there is acceptable dress code for various occupations and if the person dressing in high heels and a mini-skirt were trying to cause an affront, then it might end up in termination. I think the best way of finding out would be to go to work dressed like that and see what happens, they might just see the funny side of it and not take any action. Good luck Judge!

Most companies have dress codes. I assume your county has one to. If you signed an employment agreement to abide by the dress codes you could be fired legally. Some states are also "fire at will" states and the employer doesn't have to give a reason for firing you. You should think not just in terms of your rights but how others will view you. Do you think most of the people coming in your court room will think of you as a professional or someone who is looney?

A solid colored judges robe has a much more somber tone to it than a hot pink miniskirt and high heels and is much more appropriate for a judge to wear when dealing with issues that have a huge imapct on people's lives.

You will also not be respected professionally. If you like to dress cross gender for whatever reason you should keep it for after work or when your chamber door is locked.

True story: The San Francisco office of the firm I formerly worked for hired a guy to serve in some sort of administrative role. He interviews in a suit and tie, gets the job. On his first day he shows up in womens' clothes. He misrepresented himself and the firm can fire him post haste, right? Oh no, not in the People's Republic of SFO with the "rights" for the transgendered.

So to answer your question, in SFO yes. Knock yourself out.
