Unless you and your ex are fighting for sole legal or physical custody, you don't need a lawyer.

You can set up a visitation schedule with an informal hearing in family court. How much time each parents gets usually depends on each parents' schedule, and the age of the child.

Some kind of agreement to details of when each parent will have the child should be worked out..days..hours..pick up and drop times..etc..check with at least three lawyer when obtaining one..

Well i can tell you what happened through my parents divorce but i dont know about prices. Varies from lawyer to lawyer. This is what my grandmother told me.

She said i was a little over 1, my brother was 3. She babysat for us while my parents worked. he came and picked us up as usual, but he took us to his parents house and my mom didnt know why and he finally called saying he wanted a divorce partly because he was already seeing another woman, my soon to be step mom.

My grandmother was suffering from cancer at the time but was still fairly active. however they used it against her, and they made it seem as if my mom was too poor to take care of us, so he got full custody and we could only see her on the weekends.

So you can achieve anything you want. You can have it to where you have an even time, or you can make it to where your child only gets to see the father 2 days every 2 weeks like us. My words to you would be think about your child and not about what you want. That is their father and they NEED to see him. It caused me a lot of emotional problems in my child hood not seeing my mother and was one of the main factors my psychiatrists believe i developed Schizo-affective disorder.

You don't have to go to court to get temporary physical custody. The way it usually works is whoever files first is granted temporary custody. When you file for temporary custody a hearing is usually set to determine the best interests of the child/children. Keep in mind that a child needs both parents. Most divorce/custody attornies require a retainer for their representation, usually from $1000 and up just to get them to take your case. If you are granted sole physical custody you would probably get your son all the time except for every other weekend. If you get joint physical custody, you generally share the time unless you live far apart.

My parents divorced in the mid 90's on very friendly terms. They didn't even want to use lawyers because they agreed on everything and there really wasn't anything to fight for, but did anyways just to make sure all the technicalities were worked out. $5,000 in the mid 90's for a divorce lawyer. My mother sought full custody, and was granted it. My father was entitled to me every other weekend, and every other holiday. Of course it didn't work that way, my dad lived down the street and I saw him everyday, but she had a piece of paper that told her every other weekend, and every other holiday.

Know that even if the outcome of the piece of paper is favorable for you, there will be stipulations such as you can not move more than 100miles away from the child's father.
