BABY BIRTH CERTIFICATE QUESTION...?
i am wondering if anyone knows how it works in california, or anywhere for that matter, with relation of birth certificates and child support?? does it exempt the paternal father from paying child support if there is another man as the father on the birth certificate?
my sons biological father wants absolutely nothing to do with my son, ever. my husband is named as father on the birth certificate - would that exempt the real father from being ordered to pay child support??

The legal presumption is that the named individuals on birth certificates are the responsible parents. It would take court action, paternity tests, etc. to rebut that presumption and make someone else responsible. |

Actually, the name on the birth certificate is almost meaningless from a legal standpoint. If you are married at the time your child is born, he IS the legal father unless and until a court rules otherwise. |

If you decide to file against the real father for support.. you are going to be faced with PROVING that the husband isn't the father. And.. explaining to a judge why you put the husband's name on the record, if you knew he was not the father.
Once you file.. you will be amazed at how many bio fathers wind up saying.. hey, if I am forced to pay for this child, then I think it is only right that I have visitation, etc. If he gets mad at you.. he could also come after you for shared CUSTODY. If he is proven to be the father by dna.. then he will probably win rights, unless there is some horrible PROOF that he isn't fit to be part of the child's life.
It is up to you, if you want to open that can of worms. If you don't ever file against him, then the record stands as it is. If you want the support, be prepared for everything that CAN follow. You kinda can't have your cake and eat it too. |
