If there is reasonable doubt he should be allowed to appeal and be given the same opportunities as any one else.
If he is found guilty he should receive a punishment which is appropriate given the crime committed.
Personally I felt physically ill when I read the headline and I hope it didnt happen. If he did, I cant imagine a punishment that would be truely fitting for this crime, never mind the other series of attrocities he has committed.
If this happened in Iran we would all be clapping for sharia law - all includes me in this case. |

The details of the case would make a stone weep.
But my (professional) experience of the criminal justice system is that those prisoners who are inside for child-related offences have the most terrible time in prison. The other prisoners and the wardens go out of their way to make life hell on earth.
For example: although they eat in their cells, bear in mind the prison kitchen knows the meals that will be served to them and I can tell you that there's more than steak and kidney in the pies...
I'd not want to save the guy in this case from such an interesting time in prison by hanging him. |

Not everyone that is convicted of a crime is guilty. That is why there is an appeals process.
I'm not familiar with the case that you refer to, but the fact that raping a two year old IS such a disgusting crime makes it even more important that we be VERY careful to ensure that anyone convicted actually did what he's accused of.
Remember, if you're getting your facts about the case from the newspapers / TV news, then you're only getting those parts of the story that will best contribute to selling more newspapers or advertising time. That is not, necessarily, the whole story.
Remember the McMartin daycare child rape cases? The Kern county "child abuse ring" cases? In both those cases people were charged and convicted of hideous crimes against young children, and the entire lives even of people who were acquitted ruined, only for even the prosecutors to later admit that not only were the convicted people innocent, the crimes themselves never even happened.

The appeals process is there to protect the innocent of whom many have been convicted.
But he has to have grounds for an appeal and that is weeks or months (he was only found guilty less than 1 working day ago!!!) before anyone can decide if their is evidence to support an appeal.
This is just the Daily Mail whipping up a frenzy against the human rights act. According to the mail there was no-one from his solicitors to comment last night - no sh1t sherlock it was Sunday night before a Bank Holiday they were round at their mates getting pissed like the rest of us.

I've noticed over the last eight years or so that believing in the Constitution makes one a bleeding heart. Washington and Jefferson would truly roll over in their graves to find that many Americans find the Constitution way too liberal these days.
If you don't support it, why don't you go to the trouble of getting Constitutional Amendments passed? Actually, I'd say good luck with that.
Our jurisprudence System is based on Constitutional Law. The Supreme Court is in place to be sure that court cases conform to the Constitution. The appeals process is part of that.
It isn't really conservative or liberal, it's American. If you don't like it, change the laws. |

as you can see by the first reply still a shed load of bleeding hearts out there............ thought that the damage and the DNA in this case was strong enough to negate ANY chance of an appeal, or maybe the step parent is gonna try and say the kid was sleeping around.
I AGREE with your rope theory, but to be fair let him have this one appeal and then let the family have their hour with HIM alone in a cell, what is left of him after that period of time bury, hang set of fire etc etc etc |
