Being Served-Jurisdication for Civil Lawsuit?

Can a corporation/company that resides in RI file a lawsuit to an ex-employee that lives in FL? If yes, would the lawsuit be in FL or RI, since the defendant resides in FL, NOT RI?
Also, in FL if I am not properly served or served at all, does that stop any lawsuit from starting? In other words a lawsuit can begin unless you are served. Right?
How can I find out if there are any civil lawsuits filed against me state wide within the U.S.? Is there a web site that shows that shows this sort of information?

Revised answers based upon your email:
1. Yes, a Rhode Island employer can get personal jurisdiction over you in a Rhode Island court because the claim arose there. They have no reason to sue you in a Florida court.
2. The lawsuit will not start until you are served, but the judge will enter an order allowing substituted service if you are hiding from the process server. They will publish the notice in your local paper, or nail it to your door. Embarrassing. The short delay is not worth it.
3. You have to check with the individual courts. But if a process server is looking for you, there is little question that you have been sued. Why don't you call the process server and ask her where? She can even give you a copy of the Complaint, so you will know what it says and formulate a defense. Doesn't that sound like a good idea? |
